@job1785 The rapist claim was only a suspicion made by Officer Carrol. A suspicion is not Probable Cause (PC). The Judge, in his instructions, said that in order to be justified in the actions the officer's took, Diallo HAD to be under arrest, meaning they would have had to established PC, because PC = arrest. The FIRST action they took was approaching Diallo, but by the Judges instructions, they had to have PC already established. Why? Because he was on his own Property. It is what it is.

If you read the judges instructions from the crminal hearing on this case, you'd know that Diallo was standing on private property. The Officers never established probable cause to even make an approach of this man. They violated his 4th ammendment rights, and killed him as a result of that violation. That's why the Grand Jury handed down a charge of second degree murder in the case. However, the Albany Judge kept that information away from the jury in the criminal trial.
Officers aren't required to have probable cause to approach anyone. Officers can approach anyone at any time for any reason. They must have what the law calls "reasonable suspicion" to temporarily detain someone for investigation that an individual is involved in criminal activity (see the Terry v. Ohio case). During the investigative detention, the officer must gain enough evidence to establish probable cause to justify an arrest or they must release the suspect.
@rmkeeton Reasonable suspicon only applies to people who are on public property, ie the street ,a sidewalk, or a public park. If you're standing on private property, as Diallo was in this case, the officers have to establish probable cause to go onto his property to make an approach. The Fourth Amendment prevents unreasonable searchs and seizures from taking place on private property. Terry v. Ohio applies only to people who are standing on public property, it's Constitutional Law, look it up.
@job1785 No, I read the trial transcrips, and by the officer's own testimony, he was standing on the front step of his home. He was on his own property, and they went onto his property without Probable Cause. Even the Judges Instructions pointed out that the Officers weren't justified in there actions. But the jurors failed to apply the law based on what happened. They missed it.

This video is a crock, this stinks and regulations need to change. The officers thought they were being fired upon? How so? Did they see any muzzel flash emulating Diallo? Had he had a gun he would have lit up the hallway. Also you can not empty a clip in a matter of seconds the sean bell case proved that. This case even though its old, brings up those same feelings especially now with S.Bell, these cherries need to be trained or get OFF the force.
This case is a perfect example of why plain clothed undercover officers should never be approaching people on the street at night. If the person doesn't speak English, something that's probably common in a city as diverse as NY, then anything said by the cops is not going to be understood by the very person who needs to understand what's said. Only uniformed officers should be making these kinds of approaches. As this case shows, to much can go wrong otherwise.
An ability to speak English isn't required to live in America. It's an needless risk to have plain clothed officers approaching people on the street. Detective Isnora has just been charged in the departmental investigation of the Sean Bell shooting for making an approach in plain cloths. I think NYPD policy was changed as a result of this shooting.

When cops make mistakes, they just say "we're sorry and we'll try our best to never let that happen again. Our sympathies go out to the family of the deceased blah blah blah". Now if a citizen mistakes an undercover cop for a crook with a fake police badge and happens to shoot the undercover cop, it would be a lot different.
Cops rarely get convicted for these kinds of shootings, which usually get labeled mistakes. The victim's family might as well just sue the city, and agree to have the cops involved lose their jobs. Unless the cop is commiting an outright crime, or they shoot someone in a reckless manner, they usually don't get convicted in court. The shooting is just labeled a tragic mistake, and that ends it. So why even bother taking the case to court?

@job1785 The rapist claim was only a suspicion made by Officer Carrol. A suspicion is not Probable Cause (PC). The Judge, in his instructions, said that in order to be justified in the actions the officer's took, Diallo HAD to be under arrest, meaning they would have had to established PC, because PC = arrest. The FIRST action they took was approaching Diallo, but by the Judges instructions, they had to have PC already established. Why? Because he was on his own Property. It is what it is.

If you read the judges instructions from the crminal hearing on this case, you'd know that Diallo was standing on private property. The Officers never established probable cause to even make an approach of this man. They violated his 4th ammendment rights, and killed him as a result of that violation. That's why the Grand Jury handed down a charge of second degree murder in the case. However, the Albany Judge kept that information away from the jury in the criminal trial.

Officers aren't required to have probable cause to approach anyone. Officers can approach anyone at any time for any reason. They must have what the law calls "reasonable suspicion" to temporarily detain someone for investigation that an individual is involved in criminal activity (see the Terry v. Ohio case). During the investigative detention, the officer must gain enough evidence to establish probable cause to justify an arrest or they must release the suspect.

If you're standing on private property, as Diallo was in this case, the officers have to establish probable cause to go onto his property to make an approach. The Fourth Amendment prevents unreasonable searchs and seizures from taking place on private property. Terry v. Ohio applies only to people who are standing on public property, it's Constitutional Law, look it up.

He was on his own property, and they went onto his property without Probable Cause. Even the Judges Instructions pointed out that the Officers weren't justified in there actions. But the jurors failed to apply the law based on what happened. They missed it.

This video is a crock, this stinks and regulations need to change. The officers thought they were being fired upon? How so? Did they see any muzzel flash emulating Diallo? Had he had a gun he would have lit up the hallway. Also you can not empty a clip in a matter of seconds the sean bell case proved that. This case is a perfect example of why plain clothed undercover officers should never be approaching people on the street at night. If the person doesn't speak English, something that's probably common in a city as diverse as NY, then anything said by the cops is not going to be understood by the very person who needs to understand what's said. Only uniformed officers should be making these kinds of approaches. As this case shows, to much can go wrong otherwise.

Detective Isnora has just been charged in the departmental investigation of the Sean Bell shooting for making an approach in plain cloths. I think NYPD policy was changed as a result of this shooting.

The same thing happened in India in 1997. Here's what happened; location: Connaught Place, New Delhi. Cops in FULL uniform have info that a mafia team is headed their way in a navy blue sedan. They see a blue sedan, go trigger happy, kill two out of the three occupants and it turns out they were innocent businessmen. The head of operations plants guns in the car to escape trouble. His own officers blew the whistle on him and in 2007 he was handed life in prison.

Amadou Diallo was not from Guyana, as the video says. He was from Guinea, West Africa, and I think he spoke 5 languages. In any case, this posting does not try to understand the event from the victim's perspective. The video says that their intent is to prevent such tragedies from happening again, but such deaths will occur over and over again without considering the victim's perspective.

Cops rarely get convicted for these kinds of shootings, which usually get labeled mistakes. The victim's family might as well just sue the city, and agree to have the cops involved lose their jobs. Unless the cop is commiting an outright crime, or they shoot someone in a reckless manner, they usually don't get convicted in court. The shooting is just labeled a tragic mistake, and that ends it. So why even bother taking the case to court?

another example: the poorly written 'more info' on the right hand side of the page comparing this case to that of sean bell last year states that "one of the undercover officers ran in front of Bell's car to see if there were any weapons inside. Sean Bell proceeded to strike the cop with his car injuring his knee." blaming sean bell for his own death.

It ain't the cops killing all these people. The hard work of NYC cops have knocked the murder rate down from 2200 a year in 1992 to less than 700 a year today. Thousands of mostly minority lives have been saved because of the actions of NYC cops.

I'm no fan of the police. I will agree they have a tough job with tough decisions to make more often then not. I mean Diallo and Sean Bell was straight foul. There are times when they get the real bad guy which may turn out to save your life or someone you love in the near future. When I was teen I reacted real ignorant to cops but I got kids now and it matters to me if the streets are safe. Don't end up in the coroners office cause you wanna be mocho, this ain't the movies, this is real life.

Why didnt they take cover when they thought he had a gun? i worked in the same unit as these guys, I will tell you why. Because you have to go out and do your job. You get paid to catch people with guns. Every gun that was taken off the street by the street crime unit saves peoples lives. This is not mayberry where people carry guns to shoot squirrells. from a self-defense standpoint the 4 cops did not act tactically... mentioned suspect was warned but you can hear each cop shout at the same time leading to confusion, this tactical error would be amplified if they made the proper assumption that the suspect was likely to not be a native English speaker...then cops rushed suspect relatively quickly which cornered the suspect and put him in a flight or fight mode... flashlight rookies?
