the only difference between this scene in episode1 and 3 is obi wan being mindful of the living force while maul is on the high ground. and in episode 3, obi wan has the high ground,while Anakin attempts to kill obi wan without being mindful of the living force.

It is true that Darth Maul had the high ground but it was a different attack. I believe Maul was surprised for a little bit and was caught off guard, while Obi Wan who had the high ground was ready to attack. Basically I think Obi Wan was ready while Darth Maul wasn't.
