It doesn not allow the rape, but protects the victim's rights from the action as far as I know. It's stated that copulation with a girl under three cannot be considered sexual activity b/c although it ruptures her hymen, it's merely like "putting a finger in the eye" b/c the hymen at this age will grow back, just like "sticking a finger in the eye will will cause it to water, but it will heal". Once the hymen grows back she is lawfully still a virgin and hence is worth full "Bride price".
