"probable cause" does not mean he can search you just because of prior drug charges. There has to be an obvious reason (i.e. smell of drugs from the car or driver, visible residue, drug paraphernalia or something along those lines) It is your right to deny a search. Now chances are if you deny a search they will bring a K9 out to sniff around your car, they dont need a warrant for that....I honestly LOL'd when i saw this, that cop needs some pussy and his bipolar medication

You can't just ask for a warrant because you feel like it. There must be a valid, legitimate claim for asking for the warrant. And if you abuse this and lie, the police has to explain himself in front of a judge and can get into serious trouble.

Cops do not want negative marks on their folders. Enough "I thought I smelled" can get them fired or excluded from promotions.
