What really happened was that these chubby DPS cops were sitting in a coffee shop splitting a dozen creme-filled donuts some 50 miles from the checkpoint when they got the call.
When they arrived at the checkpoint they were angry and still hungry and took it out on Anderson. Just another typical police brutality case.

Laws and rights were made to protect people and their way of life. If I don't want anybody, including the officer, to see something that is private and matters a lot to me, then why should I show it if he doesn't have the law behind him?
For example, what if I was a crossdresser and had a bunch of female garments in the trunk and was embarrassed to show it, why should I show it if there is nothing legal by it?
And this children, is called PRIVACY. Something you should all cherish.

DPS has no arrest power on a Federal easement. All Border Patrol checkpoints are on easements granted by local authorities. The Federal Government has jurisdiction at these checkpoints. The DPS has no authority here. Those idiot DPS cops didn't even read Anderson has "Miranda Rights" before they arrested him. Those DPS cops are in deep do-do.

The USSC has affirmed that these types of checkpoints must conform to more restrictive powers than those afforded at the border.
For example, please read United States v. Martinez-Fuerte, 428 U.S. 543. which deals directly with this type of checkpoint. There are many other cases.

A DA charges you, a cop just arrest you. Cops don't have to tell you anything. If they do talk to you about your charges it's just to gather evidence. Don't talk to cops that are investigating a crime! Even if they want to talk to you about someone else's crime! Call an attorney, your attorney will arrange immunity, and then you can tell them everything you know. Takes 3 minutes.
Refusing to get out of a car when ordered to by a cop--isn't that, um, obstructing governmental administration? Refusal to put your hands behind your back? Same charge.
Because officers have guns, It's smart to do what they tell you. If there is a problem with a cop, Judges and DA's have the tools required to take care of bad cops.

It doesn't matter if he is a preacher or the mail man, I think it was unfair what they did to him and he didn't even have anything in the trunk to prove him a danger. He might of cooperated more I agree but it's not right for them to take the law into their own hands and abuse this man. They did not have probable cause and I think they were totally at fault. I don't think you would think it was so funny if it happened to you. Anyone getting beaten is not a laughing matter.

This Pastor should know as a Christian, we are to obey all authorities appointed over us (Rom 13:1). As long as man’s laws don’t contradict or undermine God’s word, we’re obligated to obey (Acts 5:29). When there is a conflict between man’s laws and God’s word, we as Christians must obey God first and foremost!This situation doesn’t seem to warrant Christian defiance of civil authority. This Pastor seems to be more concerned with the constitution of America, than he is in God’s eternal Word.

As Christians we must never bow down to any leader or idol in an act of worship or oath, but we are to obey civil authorities. Isn't it better to be wronged and present a Christian witness to the world, rather than take them to the unrighteous courts of man? (See 1 Cor 6:1,7)

You don't need a warrant to search a vehicle at a checkpoint. And just because he proved to be a US citizen, immigration checkpoints also have limited authority to search for narcotics.
That was granted to the Border Patrol because they often run across drugs when looking for smuggled people.

This statement is false. Anyone can refuse a search anytime. He just can't physically stop the agents from searching.
There is no requirement to prove one is a U.S. citizen, nor is there a requirement to produce I.D., at this type of checkpoint.

By the way it was an INS checkpoint. In the State or Arizona you must while operating a motor vehicle have your drivers lisence with you. A AZDL is encoded with a chip to show who you are, and is acceptable for a Federal ID. it was that simple.

If you get randomly pulled over and asked for your drivers license and you refuse, then you escalate the situation. If you then refuse to get out of the car when asked... guess what... you escalate the situation even more. You are now suspicious in Johnny Law's eyes. It implies that you're hiding something. In the pastor's case he was not, but you can see how if he just listened to BP the first time it wouldn't have escalated to what you saw. Watch an episode of Cops .

What really happened was that these chubby DPS cops were sitting in a coffee shop splitting a dozen creme-filled donuts some 50 miles from the checkpoint when they got the call.
When they arrived at the checkpoint they were angry and still hungry and took it out on Anderson. Just another typical police brutality case.

Laws and rights were made to protect people and their way of life. If I don't want anybody, including the officer, to see something that is private and matters a lot to me, then why should I show it if he doesn't have the law behind him?
For example, what if I was a crossdresser and had a bunch of female garments in the trunk and was embarrassed to show it, why should I show it if there is nothing legal by it?
And this children, is called PRIVACY. Something you should all cherish.

Pastor A, I had another comment which I accidentally erased maybe you have a copy of it there, so alteast you can read it. My point was that I don't mean to offend, but having myself on more than one occasion tried to stand up for my rights I too was mistreated, not with such abuse, but I think these satanic influences are growing they really hate us because we have clear minds and hearts and they know this. I disagree. They have 2 obey our rights just as we have to obey the rules. His rights were being violated & they didn't need 2 use violence 2 make their point. There R numerous videos of police abuse that was not needed & it used 2B popular to say that AA were targeted but now when its those of another race then it's that persons fault. I think NOT! An old white man was tazed, 2white women beated by police & strip searched all these experiences w/law enforcement prove that they R not 2B trusted.

DPS has no arrest power on a Federal easement. All Border Patrol checkpoints are on easements granted by local authorities. The Federal Government has jurisdiction at these checkpoints. The DPS has no authority here. Those idiot DPS cops didn't even read Anderson has "Miranda Rights" before they arrested him. Those DPS cops are in deep do-do.
The BP attorneys are sitting back and laughing. It will be the last time DPS will ever respond to a checkpoint.

There was no big deal with it but he was expressing the rights that we have to not be searched. If we continuously comply even though we know there's nothing to worry about then our rights to not be searched without a warrant will be gone forever. Taking away even one of our rights to be safer is just madness.

BUT, I advise everyone that if a cop wants to talk with you (I don't care about the subject) the next words out of you mouth need to be, "am I free to leave or do I need to call my attorney, because I don't talk to cops." If this Anderson guy knew what he was doing he would be looking at a lawsuit but now he will go to jail. Anderson is just a mentally ill guy doing crazy stuff.

ummmmmm, the Declaration of Independence was never intended to be sited as an interpretation of the bill of rights or the constitution. It can not, as it preceded both documents. If you brought that up in court the Judge would tell you to be quiet. What makes you try and play Lawyer? Do you give medical advice to cancer patients too?
Nevertheless, anyone that is physically inside the US is afforded the same rights as everyone else.

This statement is not true.
The USSC has affirmed that these types of checkpoints must conform to more restrictive powers than those afforded at the border.
For example, please read United States v. Martinez-Fuerte, 428 U.S. 543. which deals directly with this type of checkpoint. There are many other cases.

A DA charges you, a cop just arrest you. Cops don't have to tell you anything. If they do talk to you about your charges it's just to gather evidence. Don't talk to cops that are investigating a crime! Even if they want to talk to you about someone else's crime! Call an attorney, your attorney will arrange immunity, and then you can tell them everything you know. Takes 3 minutes.

Because officers have guns, It's smart to do what they tell you. If there is a problem with a cop, Judges and DA's have the tools required to take care of bad cops.
Note, IF you have a problem with a cop call an attorney, police departments will want to keep investigations internal. You need to get your charges before a DA and/or grand jury
