I stand proudly for TPB. This copyright thing is growing out of control, especially here in the U.S, with this Orphan Bill. The conspirators of the free market are trying to capitalize on everything we own. TPB is how we share what each other has, not steal. Whats the big difference if i bought a CD, burned a copy for each of my friends? The exception is that instead of burning the CD, i copy the CD and let them burn it themselves when they're ready.
The prosecutors are holding this trial to try to lower the occurrence of piracy, and have now succeeded in getting a video released that gives detailed instructions on how to pirate... super job
They are fighting with Internet culture, the only way they can win is shutting it down. That's not gonna happen, there's much more money in the net than in the music.
They are also sueing IInet (ISP) in Australia for allowing pirating to be done over their network.

The FBI track the hardcore pirating groups and bust them as well, TPB is only relying on a law (that can be changed at anytime) to stand behind.
I like the TPB and used it but FFS the RIAA/MPAA are wanting millions out of them and these guys seem to think that part of the law will save them everytime.
You can only sue some one twice for the same thing. Which means that even if the law has been changed, TPB (or any other tracker for that matter) could find another way to share the files. If they are then sued again, they could (again) find another way to share the files and they will be safe.
P.S. I do live in Holland, and this scenario applies here, I do not know if this goes for any other country.
The law can never be changed in arrears, it can only be changed from "present" and further on. So it could be a new law suit if the law is changed, but only from the time the law was changed and onwards. And a law suit can be appealed that is true but it will become a prejudice and similar trials will be judged the same, which means a new suit is meaningless.
I don't think this case is the same as the last one though, which is the reason why I've been asking, if it's a conduit type case in which the TPB could get shut down.
Riaa should be able to appeal the case say 5-10 years after the case, that's the typical thing in law so even if RIAA don't appeal straight away they could hold off for a 1, 2 years then appeal again.
Only way the really get out of the appeal would need the judge to not allow appeals, even that can be over turned tho.
Yes maybe, but you if it's the same as Australia then you simply appeal or goto a higher court, each time costs more money and time plus you'd get eatra appeals as well.

In Australia the MPAA are sueing the ISP iiNet for allowing people to pirate files via their network/ISP.
Not much has been said but the laws in Australia are fairly much the same as the USA since the freetrade act happened a few years ago

Exactly!, it's as easy to upload to TPB as it is to send via email, or im, or send vía normal mail in a cd, etc, etc. If TPB can be found guilty, then all of them will be as guilty... Now, why would the mail service be guilty over something their users do? If they are not guilty, then TPB isn't neither.
TPB isn't solely used for pirating files either, it's a service that enables you to upload everything. You can share the movie you made as a school project, as well as your own music. The site shouldn't be responsible for the users actions. That's the point. otherwise they should sue Microsoft for MSN as well as google since you can find illegal torrents through their search engine to. Or why not Apple, since people stor illegal files on their product. They should sue the internet while on it.

The service is still there for everyone to use for everything they might use it for. You can't hold the people behind the site responsible for the users actions. The only way to restrict filesharing is by restricting the internet, and that would be a big blow against human freedom. Since the Internet is the only democratic and free communication plattform in this world.

This was made to inform judges about what a torrent is and how to share them.
I understand the Swedish and just wanted to say that subtitles in english arent REALLY necessary since he is just saying exactly what he is doing on the computer.
The main point of the last two minutes was that the Torrent is NOT the actual book he wants to share. If he is not logged onto his torrent program, then no one can download the file. Important point for the judges to understand.
Can we have it translated to english?

Correct but the RIAA/MPAA would never sue the mail service as it isn't solely used for pirating files.
Where as TPB to be honest boasts about having and basicly being solely around for pirating files.
It's really only been in the last few years the TPB has been trying to make out you can use it for other stuff.
All these sites and pirating forms only last for so long before it gets busted, wiped out or whatever else happens.
