The Jim Crow laws ---- state laws MANDATING under criminal penalty, the segregation of Blacks and Whites ---- was unconstitutional, violating the First Amendment's guarantee of freedom of association, because Whites who WANTED to integrate were forbidden to do so. The Jim Crow laws made the CRA 1964 necessary, but while that was being passed, they ALSO forbade private individuals from discriminating, and thus violated the First Amendment in the other direction.

The CRA 1964 should ONLY have outlawed the Jim Crow laws, which business owners sure as hell did not want anyway, because it was an added expense and resulted in a great loss in revenue. It should NOT have gone any further, in forbidding the right of private individuals and organizations to discriminate. This right is protected by the First Amendment.

Rulings such as this should have been made by the Warren Court, but, then again, the Warren Commision was a total fraud.
