Young man please get your fact right...New York State Police did not refuse to arrest anyone, they told their supervisors they did not have the man power to arrest which could have led to a major confrontation since it WAS a peaceful demonstration. It is against Santa Barbara city municipal code to sleep/camp in a city park. If you want to change things then start with those in Washington DC first, and change those idiot politicians who have cause all this crisis, not the police.
Some don't want to acknowledge all the consequences of their actions and then, try to bury, hide and destroy all the evidence of the effects of their mistaken action. Therefore, it is better to always think about what the best action is for everyone rather than anything less than everyone.
So they cited the tent, and when they refused to take it down, they asked them to at least remove the medical supplies so they wouldn't be confiscated. When the protesters refused to remove them, because they would rather they were confiscated, the police removed the medical supplies and the lawn chair FOR THEM before taking down the tent. So they allowed them to still treat people medically with the supplies, which the protesters didn't want?
That female sergeant believes that city municipality codes supercede the constitution. I confronted her the other day before she went into speak to the city attorney and I asked her about if city codes are above the constitution and she said yes.
@DutchsMaria Actually state and local laws may provide more protections than the Constitution does. The usual rule is that state laws must match or exceed federal laws.
@Gitemstevedave I said so below....The Tenth Commendment. But there were State law or local ordinances do not triumph the Bill of Rights, The U.S Constitution overrides. So what is the charge in this case?
@DutchsMaria Santa Barbara Municipal code: 15.16.070 Unlawful Areas to Camp. It shall be unlawful for any person to camp in the following areas except as otherwise provided for:
(1) Any public park;
(2) Any public street;
(3) Any public parking lot or public area, improved or unimproved...
That is what the tent owner was cited for. They weren't told they couldn't assemble. They were told to take down a tent. So what amendment was violated?
@Gitemstevedave I never said any amendment is violoated. I responded to someone else saying that the U.S Constitution trumps State and Local laws unless it is NOT covered under the U.S Constitution. That is WHY the Tenth Amendment was created. To hand the power on anything NOT covered in the United States Constitution in the hands of the States or respectively the people. Did you actually read WHAT I wrote?
@Gitemstevedave If and pick up Glenn Greenwalds book 'With Liberty and justice for some' you will find how the rich and high govt officials are NOT held accountable on serious crimes committed under the law with Richard Nixon the 'Law and order' man holding first place. While the little guy is incarcerated at the worlds highest percentage rate at whopping 25%, the U.S only having 5% of the world population, Presidents and high govt officials like Libby ousting a CIA covert agent for example..
@Gitemstevedave Its called the Two Tier Justice System. btw Occupy Oakland was infiltrated by police and it is documented here on YT under the title..Anonymous - Occupy Oakland.
@FirePenguin731 But what is NOT covered under the U.S Constitution is left up to the States or the People...Tenth Amendment.
'The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people'
@FirePenguin731 Have you read the Constitution? I ask because I find many who scream about what it protects and say have never actually read it that well.
This arbitrary police action... confiscating a tent that provided basic first aid for occupiers... is pure horse-shit. Its only going to make people angry. Perhaps thats what they are trying to do.

@FirePenguin731 The U.S Constitution is the Law of the Land and overrides all state and local laws!
