Yes, but the differnce is that the "authorities" who decide to keep you in hospital are <b>independent</b> expert of their fields, i.e. Doctors, who's assessment are based on science/evidance that can be scrutinised by their peers and not merely an opinion.

My understanding is the prosecution and defense present their case to the jury as to why the defendant is guilty or not based on the evidence presented...

So if the persecution has, for example, telephone recordings of the defendant saying he is going to do bomb on so-and-so date then any right minded jury will find him guilty based on that piece of evidence. Now it's up to the defendant's lawyer to present something to discredit the persecutions evidence along the lines that he said those things under duress, for example.

I'm no legal expert, but I think Guilty is the wrong term here. They are not convicted of a crime. But are detained, while they wish to remain in the country. I do not know why the procedures they use don't go further to validating the evidence thats used to detain them, but I would think it has something to do with there not actually being a trial. I understand why some people would think that they could get it wrong.
