  • Ive been in law enforcement for 17 years. This is embarrassing. A 16 year old kid with a camera posing no threat, being cooperative and answering questions posed to him hardly calls for this treatment. Check his camera, check his person, check his phone, check his vehicle, call his mom then and send him on his way with a warning. Done.

  • You need to educate yourself on your rights. There were things you could do and say to make this situation go a lot better (for you) and get the bad cops off your back quickly.

    "See something, say something" is going to lead ot a lot more of this kinda bully-cop action.

    While I am NOT a lawyer, I sincerely hope that you are fighting this BS with everything you have. I would suggest contacting the media and making the PD as embarrassed as possible. Should the railroad want to protect their right of way ... it should be posted. Also, treating a MINOR in this manner is appalling. I would also consider a charge of harassment on the RUDE officer involved. Just how was he physically threatened by a 16 year old? Did they read you your rights?

  • This is atrocious and despicable, the only words that I can use to to label the local police as, I cannot comment on the MTAPD because I didn't here enough of what their personnel does.

  • Look, as an engineer, we see people hanging out by the tracks, I don't know what type of area this is in, but in many areas I go through I get rocks thrown at the windows and even shot at. Many times I will report someone by the tracks if they look suspicious. That being said, this should have been handled by the railroad special agents. Local police have no jurisdiction on the railroad. And I doubt that a train crew reported you because it would be referred to railroad police.

  • If I did get this ticket I would call the railroad and explain your story and ask them if they want to drop your trespassing charge. You are getting a ticket for trespassing. It is their property and if they side with you they can simply get the charged dismissed. Keep in mind trespassing is a simple misdemeanor. It is no more harmful than a jaywalking ticket. Best not to argue with the cops if possible and deal with it later. I would avoid crossings.Too many people and they always call the cops

The Railroad was trying to protect their property, just like you would protect your property if someone was trying to video tape you while in your house.   • The District Attorney did not like the fact I had a letter from Metro North saying that it was ok for me to take photos there. So now the case was ajourned to Septemeber 2nd.

  • this same shit happened to me. i was trying to get a video of these new style trains with 2 levels and a weird shaped front end. and i was arrested for being there and it was called "tresspassing and destruction of state property"

  • This crap has to stop. Railfanning, liike shooting planes at airports, has been a photographer's staple for decades. Some folks not connected with the arts just don't get it. There needs to be a nationwide coalition of photographers to fight this ignorance. Another sad part about this incident besides the obvious is that while these officers were detaining this guy there might have been a REAL crime being committed somewhere.

  • Also, if they hand cuffed you, they were out of line. It is illegal to detain anyone unless the police feel threatened and that they are POSITIVE that you broke the law.

  • If this ever happens again, tell them you request to speak with their Watch Commander immediately . By law they must oblige. Also, speak only when spoken to. Don't say "But I'm answering your questions!" Many cops get pissed off by this. Answer their question, thats it, nothing more nothing less. Also, ask for their names. They must do so.

  • However, on your part, never ever volunteer info without being explicitly asked for it. Don't tell them they can look in your camera because that opens up an unclosable door. There's a thing as "serach incident to an arrest" but never give cops permission to search anything without a warrant. And never resist arrest or commands. If they do wrong they get nailed in court, but if they do wrong and you resist then you are screwed. Last, ask them to define what "near" & "device" mean.

Seeing how you were underage/non-violent they should have never handcuffed you and that possibly was illegal for them to do so.

  • There's 2 key elements against the cops here: 1) After you asked for a lawyer or your parents that's when all questioning should have ceased. It sounds like it did not but your video is only 3min so what goes on after? 2) A tipster calls in someone kneeling with a device near the tracks, and you fit the description. OK, cops check it out, but now that you have court summons you have a right to face your accuser. No accuser, no case. (continued to next comment)

  • I have to say something because this bugs me. Having been in law enforcment there's no need to yell until the subject gets belligerant. Obviously the yelling cop was trying to get you upset. The other one sounded like he was trying to calm you down. Some cops like to rile people in hopes of getting them belligiarnt so they can get them on resisting arrest, an unbeatable charge regardless of why they're there in the first place.     My question is were your remaining on the premises "unlawfully?" Did the property owner tell you to leave?

  • @TheGrayman1234 The summons itself is actually pretty interesting. The offence is trespassing but in the information section it states "Enter and remained unlawfully next to the railroad track area". Standing next to the train tracks on public property is not illegal. So basically you got a ticket for trespassing on public property. No where in the summons does it state that you were actually on the railroad tracks but rather just in the "railroad track area".

  • I can't get the link to work Gregory, but go to railroad.net. I'm sure you're familiar with that site. On the metro north forum, at the top of the forum on a sticky post, is the railroads photo policy. It is a memo from the railroad chief of police to his officers that non commercial photography has no restrictions other than not to trespass on railroad property or be in a dangerous area. I don't see where you were either trespassing OR in a dangerous area. Sue those keystone cops.

Thats why I carried the personal email, which they totally disregarded. The MTA has also posted in their rules on the website that photography is legal systemwide

  • @AuroraFoxNEC That does not matter at all, you can take pictures, use tripods and use a flash of whatever you want as long as you are on public property. That MTA rule only applies to MTA property not to public property. There is no law or rule that makes it illegal to take a video of a MTA train using a tripod. As long as you are on public property you are free to take pictures and videos of whatever you want to.

  • The main point is that if this were the Amtrak NEC, and you registered with them as a railfan, they would have no right for harassing you. Amtrak started that program because railfans wanted to help Amtrak police the line, and in meetings told them that, straight up. Maybe NYMTA needs to follow Amtrak's lead.

    The main thing is that this is a Metro North (NYMTA) owned line and not an Amtrak owned line. That means some prohibition of being "on the line" for safety reasons...

    ...which the police should have just came out and said so, given you the summons, and sent you on the way. But 5 cops from 4 agencies, being unprofessional? Grab a lawyer.

  • Definitely make sure this video gets out, that is how you make a difference. I hope you got the names of all the officers. There was another video that came out about a month ago with someone taking pictures and was detained. If you were 10-15 feet from the track and behind the barrier you can kneel down and do whatever you want. If you really wanted, and if you have a good case which I believe you do, you could get money out of this by threatening to sue for police misconduct.

  • Many years ago, prior to the attacks of Tuesday 11 September 2001, I was homeless and would sleep in my car next to the railroad yards, just so I could watch passing trains.

    Only twice, did police stop and ask what I was doing, and that's all they did, just making sure I was safe and not freezing to death.

    It was before most of you young'uns were born, and America was different then.
