Everyone has driven technically drunk don't be hypocrites. You know how much of a cash cow booze is for cities, states, and counties that allow it. Forget about DUI revenues, you have liquor licences, and lot's of after hour jobs for law enforcement standing around in bars.
Ya do nothing especially if you are really f'ed up. Then hire a lawyer ASAP. Don't blow or do a roadside test. Even if you happen to be forced to give blood (example: you hit a telephone pole and they get you at the hospital) it can easily be tossed out in court. I have not had a drink in 6 years but got 2 slam dunk deweys cut to "failure to contols" with no "alcohol related" and they had me at .27 on one. Shut up, do nothing, get a good lawyer.
this old fat fuck is trying to get people get away wit driving drunk.. those guys that get away wit driving drunk b/c they listen to this dumb ass probably ended up crashing and killing some1
Here is the senerio, a cop pulls you over, your drunk. You follow these steps, and get away with it. 10 minutes later, you get into an accident, kill someone, lose your license for life and go to prison for years and years and years. Just dont drive drunk
@CCombo501, your saying not being able to drive drunk is a violation of your rights?
I do not need a license to travel in my private capacity in my private mode of conveyance. Shapiro v. Thompson : 394 US 618 (1969). The state cannot take a right charge a fee and issue a license for it.Mudook v. Penn. : 319 US 105 (1943)
And If They Do Shuttlesworth v. Birmingham Al.: 373 US 262 (1962):
you can ignore the license and a fee and engage the right with impunity.”
That Means You Can't Punish Me. All SCOTUS decisions never overturned,or set aside!!!
@MrGrevy No,and you didn't bother to see the cases.Your personal attack certainly shows a lack of intelligence on your part. That is because you don't know how to research case law. So shut your cake hole.
No, Hitler, I won't be shutting up. Your claim is simply absurd, regardless of how you interpret the case law. According to your very unlettered post regarding your interpretation ofShuttlesworth v. Birmingham - you don't need a drivers license. I assure you, you DO. Argue this nonsense in front of a judge and enjoy being laughed out of court. I don't understand how you can be so mistaken. I invite you to argue those points to a judge and see where it gets you.
@MrGrevy no I beat the charges ,and collected my costs and fees. That is a win. I travel in my own car w/o a lisence, insurace, and no plates. I WON MY CASE!!!
@MrGrevy In fact the judge dismissed the case with prejudice,so it will not come back. I think you are just a troll with no legal experience trying to attack those who do,you should be aware of KARMA pal.Its coming for you. Your foolish ad homenim attacks lend no credibility to your comments, but those with no positive lives tend to do just what you do, but I'm sure your Mom is proud of the fact you still live in her house as a non productive wart and a burden, and a subject/slave 4 govt
you refuse to blow a breathlyzer in Colorado, you lose your license for a year. you can get a dui by just the impression of the officer saying "hey i smelled alcohol" jeez im moving to MA
@jon1151 Mass is a good liberal state. Most States don't afford you these rights due to the neo-NAZI MADD idiot's political clout and influance. MADD is the real enemy. Mass DMV also does not share driver records with other States (or at least they didn't) so if you live out of State you can leave and not worry about being ratted out to your home State's DMV which gets really nasty.
@ThePodpie I always thought Mass was a good Dem State that respected people's rights. The closest I came was Connecticut for 8 months but I heard good things about Mass.I know it's the heart of the Liberal establishment as in Ted Kennedy and others. I can't speak factually because I'm only saying what I've heard from people I worked with. I did get a dui in Ct. and I live out of state, what a pain in the ass to deal with 2 States They wanted to lock me up for 2 years.
Here is some advice on drinking and driving and not getting caught. Don't fucking drink and drive! I have seen way too many wrecks, and it almost always turns out in death! Yes I drink, but I will have a designated driver, or I will stay where I'm at till I sober up! Just please don't do it and then you will not have to worry about going to jail for DUI.
In addition, although this lawyer may be giving good specific advice for MA, he doesn't consistently differentiate it for other states, making poor advice for some people! For example, in KS, you will lose your license for 1 year if you refuse to give a breathilizer or sobriety test.
My opinion (and other experts') is that you should NOT find and get your license and registration papers ready BEFORE the officer requests them. Because, when you're looking through your car for them, how is the cop to know that you're not hiding illegal items, or going for a weapon? Furthermore, you may have to take off your seatbelt to do the above actions, and that could be an additional ticket (not wearing your seatblet), if you don't have it on when the officer comes to your door.
This man clearly does not know what he is talking about. You SHOULD NOT start fumbling around looking for your drivers license and registration. Some officers may interpret this as a sign of danger. How the heck should they know you're not reaching for a weapon/gun?
@mzchristina908 You shouldn't have to "fumble around" to find your license and registration. They should be kept in a spot that you can quickly and easily get to. As soon as you have your license and registration out, put them in your hand and put both hands visibly on top of the steering wheel. This shows the cop that you do not have any weapons in your hands and are not attempting anything suspicious.
This guy is a complete idiot.... just don't drink and drive....
You won't even remember this idiots instructions anyway if you are pulled over if you are drunk. If you are sober, you will have nothing to worry about. SLIMMY DEFENCE LAWYERS..... I wonder if he will change his story when his kids are killed by an impaired driver.
@MikeSusb Our rights are here to protect innocent people, the police's job is to arrest and help convict people, whether they are innocent or not. Simply not breaking the law will not protect you from being prosecuted and convicted of a crime. You must exercise all your rights whenever possible, especially the 5th amendment.

Again.... if you were not drinking and driving you would not have to worry about the 5th amendment. true. here allot of people are convicted on DUI not DWI because they take cough medicines or other medicines. if they can prove it theyll charge it. here anyway.
how can a cop have a reasonable probable cause, when the cop himself isnt reasonable, all a cop has to do is say he smelled something or noticed you act nervous..."what ya so nervous for?? you dont mind if i search your vehicle do ya? no? well what are you hiding!? we can do this the easy way or the hard way....i can call in the dogs...show your fuckin papers! you in the backseat! you look funny, get out of the car with your hands up and get down on your knees slowely, ive got a present for yu"
Wrong, If an officer has pobable cause to ask you out of the vehicle andyou refuse. Then you will be sucked out of the driver side window and also charged with Obstructing Government Administration.
To a person that has been drinking to the point that they should not drive, they are probably better off refusing tests and refusing to answer questions because they're going to lose their license either way. License revocation is an administrative penalty and not the same thing as being charged with the crime of DUI/DWI. So in other words you are just cutting your loses if in fact you have had too much to drink. If you're sober then you should probably just cooperate.
exactly.... whats this guy trying to do get people shot?!? if they say get out the car.. say I'm not gonna??? whoa I'll tell anyone watching right now your gonna get your arse handed to you AND locked up.. lol
Also, consider all the ways that a police officer can draw a passenger out of the car in order to bring them into a situation where they qualify legally for being "in public"...
it is up to local GOVERNMENT--in TN you can have an open container as a passenger--but in washington both are liable as long as intoxication is in play
the answer lies in the by-laws of the governing officials of your city-if your drunk--and in public--then your imminent domain to the governing laws therefore established-san jose is lax--new hampshire is crazy
and this video is not very good. u do not want to look for ur registration and license while the cop is still in his car. if you do he is then able to say it looked like you were trying to hide drugs or he might also think you have a hidden weapon in the car and then has probable cause to search.
hell yeah. I'm sick of professors giving me free advice in their particular field of expertise at no cost. If the info really was that important or worthwhile, they'd be selling it in a late night radio ad or annoying pop up. Fuck this kunt!
yea you guys need to update this in alaska it is .008 and if you refuse to take the breathalyzer test you can not drive for 90 days it is a form you have to fill out before dmv will let you drive
This is a bunch of non sense. An officer can order you out of your vehicle for any reason. Refuse a chemical test? I don't think so. If you do I will have a warrant for a blood draw before you know it. Still refuse? I will hold you down, strap you down and we will get a blood draw. Not to mention the other charges that will be added-felonies to. So..go ahead and refuse. Best bet? Don't drink and drive because you WILL not win.
YEAH RIGHT YOU MUST BE A COP. TRY TO DRAW A SAMPLE NOT BEING A MED PROFESSIONAL. SEE HOW QUICK A DEF. ATTY. POUNCES ON THAT. CAN'T SPEAK FOR RNs IN GENERAL, BUT YOU'D PLAY HELL GETTING THE RNs HERE TO BE EXPOSED TO A DEADLY NEEDLE STICK FROM UNWILLING PATIENT. STRAP 'EM DOWN? BULLSHIT. NO ONE HERE WILLING TO FACE POSSIBLE LITIGATION FOR PERFORMING PROCEDURE WITHOUT CONSENT. YOUR WARRANT IS SHIT.
WARRANT IS TO OBTAIN BLOOD FOR THE PURPOSES ASCERTAINING ETOH LEVEL. DOES NOT MAKE A NURSE A PROTECTED AGENT OF THE COURT. SUGGEST COPS BE CROSSED TRAINED IN PHLEBOTOMY AS TO COLLECT THEIR OWN DAMNED EVIDENCE.
This is the mentallity of our police force is people. What a sick twisted world when your constitutional rights are trampled by some jackboot thug straight out of the academy.
Regarding the field sobriety tests, I would love to see a cop demonstrate these, espcecially the "Recite the alphabet backwards" one! That's rather tough even when you are clear-headed and don't have an intimidating cop glaring at you!!
Do what ricky does on trailer park boys, just say to the cop "hey you know jim right?" Everyone knows someones named jim and they'll say yes and since your friends with his friend he wont arrest you.
I wish I had watched this vid earlier before I was almost arrested. in 1998 I was carrying a computer in a large box in the rear of my car and when I hit a gentle curve, The box slid, so I reached back and grabbed it, causing me to swerve, and I got pulled over for him thinking that I was intoxicated, and just because I looked like a mischievous young driver!!!!!!
He doesn't know how to spell "lose"...and he's giving law advice!!! He warns us that we are going to "loose" our license!!!! Nah, that's your mom...she's loose!!!
SRTguy06 is right. I don't know where this guy got his law degree, but he is wrong on many counts. The Standardized Field Sobriety Test was designed in the late 1970's by Dr. Burns and Dr. Muscovitz at the Southern California Research Inst. The SFST has been validated over the years by many research groups in several different states. It was not designed to fail. It was designed to divide the attention similar to driving a car is a divided attention task.
both the title and the comments fail to notice... What if you really are not drunk, totally sober? Police do make mistakes so what about people like me, who do not drink. I want to know how to best protect myself from "Police errors". others might say that is rare but still it happens.
yea, I wouldn't listen to this guy because a lot of what he is saying is BS. A police officer can order you out of a car for any reason, not just a suspicion of weapons, and this is upheld in the supreme court. Sobriety test are not designed to make you fail, especially when talking about the horizontal gaze nystagmus. You can still be convicted of OVI with probable cause, he fails to mention this. Here is the best and only advice you need... DON'T DRIVE DRUNK!!
Not in Mass....Other States may allow it but Mass. is just like this guys states...read some case law you will see that Mass Constitution gives Citizens here more rights than in other States.
Everyone has driven technically drunk don't be hypocrites. You know how much of a cash cow booze is for cities, states, and counties that allow it. Forget about DUI revenues, you have liquor licences, and lot's of after hour jobs for law enforcement standing around in bars.

No evidence!!!!!!!!!!!
: )
try again better next time.

I have better idea. Do not drink ANYTHING and drive... Plain and simple...
If you do drive erratically and you've been drinking, YOU'RE DRUNK!!! It doesn't matter if you a little drunk or really drunk, YOU'RE DRUNK.
