  • Everyone has driven technically drunk don't be hypocrites. You know how much of a cash cow booze is for cities, states, and counties that allow it. Forget about DUI revenues, you have liquor licences, and lot's of after hour jobs for law enforcement standing around in bars.

  • Ya do nothing especially if you are really f'ed up. Then hire a lawyer ASAP. Don't blow or do a roadside test. Even if you happen to be forced to give blood (example: you hit a telephone pole and they get you at the hospital) it can easily be tossed out in court. I have not had a drink in 6 years but got 2 slam dunk deweys cut to "failure to contols" with no "alcohol related" and they had me at .27 on one. Shut up, do nothing, get a good lawyer.

  • @jon1151 Mass is a good liberal state. Most States don't afford you these rights due to the neo-NAZI MADD idiot's political clout and influance. MADD is the real enemy. Mass DMV also does not share driver records with other States (or at least they didn't) so if you live out of State you can leave and not worry about being ratted out to your home State's DMV which gets really nasty.

I can't speak factually because I'm only saying what I've heard from people I worked with. I did get a dui in Ct. and I live out of state, what a pain in the ass to deal with 2 States They wanted to lock me up for 2 years.

  • Here is some advice on drinking and driving and not getting caught. Don't fucking drink and drive! I have seen way too many wrecks, and it almost always turns out in death! Yes I drink, but I will have a designated driver, or I will stay where I'm at till I sober up! Just please don't do it and then you will not have to worry about going to jail for DUI.

  • In addition, although this lawyer may be giving good specific advice for MA, he doesn't consistently differentiate it for other states, making poor advice for some people! For example, in KS, you will lose your license for 1 year if you refuse to give a breathilizer or sobriety test.

  • My opinion (and other experts') is that you should NOT find and get your license and registration papers ready BEFORE the officer requests them. Because, when you're looking through your car for them, how is the cop to know that you're not hiding illegal items, or going for a weapon? Furthermore, you may have to take off your seatbelt to do the above actions, and that could be an additional ticket (not wearing your seatblet), if you don't have it on when the officer comes to your door.

  • This man clearly does not know what he is talking about. You SHOULD NOT start fumbling around looking for your drivers license and registration. Some officers may interpret this as a sign of danger. How the heck should they know you're not reaching for a weapon/gun?

  • @mzchristina908 You shouldn't have to "fumble around" to find your license and registration. They should be kept in a spot that you can quickly and easily get to. As soon as you have your license and registration out, put them in your hand and put both hands visibly on top of the steering wheel. This shows the cop that you do not have any weapons in your hands and are not attempting anything suspicious.

  • @MikeSusb Our rights are here to protect innocent people, the police's job is to arrest and help convict people, whether they are innocent or not. Simply not breaking the law will not protect you from being prosecuted and convicted of a crime. You must exercise all your rights whenever possible, especially the 5th amendment.

  • Wrong, If an officer has pobable cause to ask you out of the vehicle andyou refuse. Then you will be sucked out of the driver side window and also charged with Obstructing Government Administration.

  • To a person that has been drinking to the point that they should not drive, they are probably better off refusing tests and refusing to answer questions because they're going to lose their license either way. License revocation is an administrative penalty and not the same thing as being charged with the crime of DUI/DWI. So in other words you are just cutting your loses if in fact you have had too much to drink. If you're sober then you should probably just cooperate.

If you do I will have a warrant for a blood draw before you know it. Still refuse? I will hold you down,strap you down and we will get a blood draw.   • I wish I had watched this vid earlier before I was almost arrested. in 1998 I was carrying a computer in a large box in the rear of my car and when I hit a gentle curve, The box slid, so I reached back and grabbed it, causing me to swerve,and I got pulled over for him thinking that I was intoxicated, and just because I looked like a mischievous young driver!!!!!!

The Standardized Field Sobriety Test was designed in the late 1970's by Dr. Burns and Dr. Muscovitz at the Southern California Research Inst. The SFST has been validated over the years by many research groups in several different states. It was not designed to fail. It was designed to divide the attention similar to driving a car is a divided attention task.

A police officer can order you out of a car for any reason, not just a suspicion of weapons, and this is upheld in the supreme court. Sobriety test are not designed to make you fail, especially when talking about the horizontal gaze nystagmus. You can still be convicted of OVI with probable cause, he fails to mention this. Here is the best and only advice you need... DON'T DRIVE DRUNK!!

  • Not in Mass....Other States may allow it but Mass. is just like this guys states...read some case law you will see that Mass Constitution gives Citizens here more rights than in other States.
