  • @eclpyse3d As long as they see the suspect concealing or leaving the front doors with unpaid merchandise they can make the apprehension if the suspect does not cooperate then the lp officer can physically detain the suspect until the police arrive, and the police will decide to warrant or not to warrant that arrest and 99% of the time they do

  • THERE IS NO ARGUMENT OVER THE "LEGALITY" OF THIS. They DO have the right to stop and detain ANY individual they suspect of stealing and handcuff them. They can do this at Starbucks, they can do this at a 7-11, they can do this at a ma and pa Yarn store. Its called citizens arrest. The thing is, you had better be right when you do this.

  • @THEMASTEROFYOU2000 That all depends on the state you live in. In IL a person can make a citizen arrest on any person in the commission of a misdemeanor or felony so long as they witness the act. The arresting person can also use up to the same level of force that the criminal uses (basic self defense law).

  • @Joeybjj True anyone can buy handcuffs, but it is false to say just anyone can carry & use them to make a citizens arrest. It's sort of a grey area and complicating,because on one hand security can only make citizen arrests as we're not the police and no different from anyone else but on the other hand if we have a handcuffing license then we have the legal right to carry and use handcuffs on the job when making citizens arrests, although a true citizen not licensed cannot carry or use them.

    This is Joeybjj. I am going to disagree with you, again. I am a Criminal Law student and have ample experience in Loss Prevention and private security. There is no such thing as a handcuffing license. There are certs that many times private business require you to have per their policy. There is no Security status that allows for it. Like you said we are just like anyone else. No differences. Anyone can carry handcuffs without any licenses. A true citizen is what you are.

  • @lpvidz101 Maybe where you are from but in some parts of Canada like BC, in order to carry and use handcuffs you must take an Advanced Security Training course.A certificate proving you passed, must be sent to the Registar Security Services Act where they will have it printed on the back of your security license. If the police ask if you are certified to carry handcuffs you must show them the back of your security license,where it says you are authorized to carry restraints (handcuffs only).

  • @OregonMilitia I'm not sure what fantasy constitution you've been reading, but there is nothing in the U.S. Constitution that prohibits private people from making arrests. Furthermore, under various federal and state laws and cases, it is PERFECTLY LEGAL to arrest shoplifters using force if necessary (by private persons). Wake the fuck up, read a book or two!

  • @Robert111 true but most times people do not arrest, they simply detain the suspect until the police arrive. but both are perfectly legal. especially if you are working for a big company, they will most times have your back

  • @robertpinnisi Umm, well you're going to have to review your terms. The difference between being "detained" and "arrested" comes down to an ambigious amount of time. For example, if you are stopped for speeding, you are "detained" while you are being written the ticket. However, if they take a hour to write the ticket and you are prohibited from leaving, you have been "arrested" even if you haven't been put in cuffs, etc. The distinction is very important with regards to your rights.

  • @Robert111 Actually, private entities can only detain a person without *excessive* force causing any injury to the suspect and place a 911 call with suspect's details immediately after that. ANY delay in this step, and you have kidnapping and assault. The police verifies if the suspect's health was not impacted in any negative way and if the private organization placed a call immediately. Failing this, all evidence supplied to the courts is automatically withdrawn(violation 4th amendment)

Your most ridiculous and STUPID comments is about the 4th Amendment. The 4th Amendment ONLY APPLIES TO THE GOVERNMENT. It does not proscribe private actors at all. NOTHING a private actor does will somehow trigger judicial supression of evidence. Where do you get this stupid shit from??? Either way, don't spread your bullshit, kid.

  • @Robert111 You need to take a note from your own book buddy, they cannot do this unless its on behalf of the employer or person(s) provided a felony is in progress.... Petty theft does not apply. Read up on your individual state laws but I suspect like most states this is the case.

  • @eclypse3d Wrong again, common law doctrine is that a merchant can use reasonable force to detain someone with they have a reasonable suspicion that the person took something. No felony threshold is involved at all. Unlike the pigs, there is a considerable risk involved in the event that they were mistaken (and get sued for false imprisonment). Ths is COMMON LAW, individual states are free to have their own statutes. If you have any other questions, let me know.
