The crime: They tried to make Ashcroft sign their eaves-dropping program which he had considered illegal, although Ashcroft was in hospital and had given his authority to his deputy and therefore was not in charge. The deputy did not sign the program, they implemented it regaredless (The deputy, James Comey, therefore resigned from office).

2) "if he has nothing to hide" -- If he has nothing to hide, then why does he have to show it? Especially considering that the duty to prove a crime has been committed falls squarely in the lap of the plaintiff, not the defendant. The accuser, not the accused. Etc.
