I have to admit I enjoy hearing Rod singing these songs, and love the early Deep Purple sound. There's no doubt about it (as suggested in this video), Rod Evans was the original vocalist for Deep Purple, and they had a fair amount of success in the states during that time, It was a stupid thing to do though, if anything he should have avoided what the management were telling him and toured with a name that said "The original vocalist of Deep Purple performing the music of Deep Purple".
Would be interesting to know the legal issues behind this. Did Blackmore legally own Deep Purple name? If not Rod Evans had a crappy attorney. After all, he was an original member and the band was defunkt. Like Tony Iommi's "Black Sabbath" Seventh Star album. He found out later he didn't own the Sabbath name.
@kurtisthall65 There is a major difference in that Tony Iommi was a continuous presence in Black Sabbath, whereas Rod Evans was a member of Deep Purple for about two years before being replaced by Ian Gillan. The law's the law, but it's obvious Iommi had more of a leg to stand on than Evans' did. Also, Blackmore had been out of the band before they broke up so if any of the band members owned the name it would have been Paice and Lord at that time.
My first rock concert was seeing this fake Deep Purple somewhere south of Boston, MA in the summer of '80! I knew it only featured original vocalist Rod Evans but still it was a big deal to me as I was only 17 and never saw anyone famous up to that point. But watching this footage it is painfully apparent this was a travesty compared to the real deal!
@NEWWAVEPSY Fake Steppenwolf differs somewhat to fake Purple. Several previous members were involved in Steppenwolf, it's not as bad (although still an illegal use of the name).
I suppose the worst example of a fake band was the fake Fleetwood Mac which featured literally no one who had ever been in the band.

Estuve en este concierto con la ilusion de ver a Deep Purple. La banda que toco antes de ellos fue Black Oak Arkanzas. Jim Dandy trajo a un chavito de 16 años en la guitarra que tocaba de pocamadre. El Pinche Jim Dandy no paraba de decir "que bonitas Señorritas" Yo no veía ninguna, sólo vi pura banda mugrosa colgada de las porterias de Futbol Americano. I believe "Hush" was written by Joe South. If the song is played by Deep Purple with Joe South's permission, then who ever is the current singer of Deep Purple can sing it.

He'd already left the real band in the seventies and had been replaced by Tommy Bolin, the real band even released an album without him before breaking up, Ritchie Blackmore's absence is irrelevant. What is relevant is the absence of Ian Paice and Jon Lord, who were the continuous founding members upon Deep Purple's original breakup, had they joined the project Rod Evans could have fairly asserted that it was Deep Purple.
@Burbridge92 What Rod did was only wrong because he tried to pass it off as Deep Purple without any continuous members, and playing songs that were released after his departure from the band as if they were his own and claiming them to be his.
Even the forfeiting of future artist royalties(for the first 3 Deep Purple albums) didn't recoup the enormous legal expenses of HEC Enterprises(Deep Purple's 1968-76 management) in suing the fake Deep Purple or satisfy the damages awarded to HEC by the courts. If Rod Evans ever attempted to make music again, any and all profits would be confiscated(by the courts) to satisfy his debt to HEC. His retirement from music isn't voluntary. It's enforced.

Neither Rod Evans or Nick Simper could sue for royalties from the CD reissues of the early Deep Purple recordings. After Nick Simper was fired by the group, he sued the group, and in the resulting settlement, he forfeited future artist & publishing royalties in exchange for a £10,000 lump sum. Rod Evans continued to receive roughly £20,000 per year royalties, until he started the fake Deep Purple. In the settlement of the fake Purple suit, Evans forfeited future royalties.
Rod got sued and lost he didn't have money to pay lawyer bills for Purple so lost all his royalties from first 3 albums. He then vanished and hasn't been heard of in 30 years. Some have stated that he is a nurse in San Francisco area but really, he's probably retired by now. When he was first ousted from Purple he had just gotten married to a rich lady. Nicky took cash in lieu of royalties and regrets it to this day. Love to see MkI reuinion with Rod and Nicky, Ritchie, Jon. It could happen.

Truth is, now Rod could easily front a band called Rod Evans' Purple (or similar), and no one would object. In 1980, tribute acts simply didn't exist. Also, Deep Purple themselves had a Number 1 compilation album that year (Deepest Purple), despite their having broken up. So the band was as big as ever. I also feel very sorry for Rod, who is a talent in his own right.

Bloody horrible, save some decent vocals from Evans. From 5:25 and onwards, the organ sounds completely twisted. And not in a good way. Also, the twat playing it reminds me of Manuel from Fawlty Towers.
If Rod would have been smart, he would have let go of his saying of old soldiers never die and continue on with his success as a heart surgery director. I sorta tolerated his work for Deep Purple, I really liked the amazing job he did for Captain Beyond but reforming a band that he got voted out of after a long time without signing ever since the Captain Beyond break up in the early 70s, a few random musicians sure did make a huge disaster... As if he did that!

Ouch! Evans could have called it Smoke On The Water but not Deep Purple... That's just ouch! Losing credit for the Mk 1 albums for giving the band a bad name... Ouch! @thevinnymaster - I have to disagree. He should have been sued for doing this, he and the promoters who put it together. They didn't put a gun to his head (did they?) It was a total ripoff. Five years later the Mk 2 band got back together for real, and it was 100 times better than this. This is actually worse than I remembered.
I understand the same promoters put together a bogus Steppenwolf even before this (not that John kay and Steppenwolf are the real deal).
Rod sounds remarkably like David Coverdale on this song; maybe that's why somebody thought it would work. Sad!
I remember being young and stupid; going to a dive south of Longview, Texas, because STEPPENWOLF was playing there!! And it was probably the same guys in this band, except they found some guy who could snarl and sing to be "John Kay."

While it was unfair on Evans to take all the blame for this, nobody forced him to get involved in the first place and it was very naive on his part. A pity, because he was a great singer.

There are more DP original members outside (Blackmore, Evans, Simper, Lord) than inside "Deep Purple" ! A MK I or III reunion would have more legitimity than "MK VIII"... Gillan, Glover, Airey, Morse and Paice aren't Deep Purple MARK II !!! For me, DP without Blackmore and Lord is a FAKE DEEP PURPLE...

It's true that in theory, the current incarnation of Deep Purple is about as legitimate as this one, but we choose to let that slide. I feel really bad for Rod, he doesn't deserve all this flack for making this mistake.

If this was today, Evans would've done the wise thing and started a group with Simper and three solid backing musicians and called it something like Shades of Purple, playing songs from the first three albums.
Rod Evans CAN sing heavy rock. Listen to his Captain Beyond albums, as well as Mandrake Root, Painter, Hush, etc. He doesn't deserve to be castigated all these years after 1980. If he now formed a band called Rod Evans' Deep Purple Experience (or whatever), no one would give a monkey's. And do you know who is a big Rod Evans fan? Ian Gillan. Makes you think. This was of course a travesty, but has anyone noticed there's only one original member in the current "legitimate" Deep Purple as well? Gillan sings "Hush" every night and makes a nice living, and Rod is banned for life for making one stupid mistake. It's time to the rock community forgave him and hopefully someday the mystery of his wherabouts will be solved.
Rod Evans is awesome and i hope to see him come back one day.. i totally agree.. I love gillan lord blackmore and everyone else but I also think that Evans is awesome... Captain Beyond is in my top ten albums of all time
Apart from 'Smoke On The Water', the band apparently did 'Hush', 'Kentucky Woman', 'Mandrake Root', 'Black Night', 'Woman From Tokyo', 'Space Truckin', 'Highway Star', 'Burn', 'Stormbringer' and 'Lay Down, Stay Down'.
Hehe, they performed them basicly, according to reports from people that experienced this version of "Deep Purple".
Yes, the current Deep Purple and the previous MK.7 was/is great. Not many bands has kept it going for 42 years, even though they had a break from 76 to 84. Gillan's voice is not what it used to, but he sure can belt out most of the classics. He did 'Speed King' excellent in November last year when I saw them. They also look so happy on stage.
what a pitty that TRUE Deep Purple did not keep both Rod Evans AND Ian Gillan. David Coverdale might have had a nice voice but extremely poor style (may be not on his own account)
Silver is right. Rod was approached by a management company which specialized in questionably-reformed bands with big names and began to tour under the Deep Purple name accompanied by unknown session musicians. Rod just went with it and he got screwed over. He had to pay a huge fine and he no longer gets money from the 3 records he recorded with Deep Purple. Its a shame the management company didn't get fined or anything. Rod did nothing wrong and he shouldn't of got blamed for all this.

Rod was cheated into this. This concert promotor guy got away with it. Stop flaming Rod for it. Rod took the heat for this. Rod will still be THE original Deep Purple singer and frontman in the 60's, and the music they made on the 3 first album (and covered for that matter) are top notch. Gillan is was and still is my favourite vocalist, but Rod comes as a good #2. I'm glad this was documented, even though it wasn't very well performed. Would love to hear 'Hush' etc. which they also played.

Don't talk shit. Rod Evans was an extraordinarily good singer. Listen to his singing in Deep Purple songs like "The Painer", "Anthem", "Bird Has Flown", and in the Captain Beyond albums. His voice is one of the most beautiful to ever exist in rock and roll.
Rod Evens is A remarkable musical talent and his vocal skills are incredible. His work on the first 3 Deep Purple albums as well as Captain beyond will forever make him a legend. So Sad to see him in this sham version a decision he payed dearly for. Well apparently Rod went on to become a doctor and Ian went on to write Dp songs about anal sex with strange women.

Rod was totally wronged from thegetgo when Blackmore andthe rest of purple used his vocals from songs at the end of 69 that werent even meant for Rod to sing!Those songs were meant for his replacement ( Gillian).Rod thought he was the indefinite singer after all his vocals got them on the american charts.Mark 1 of purple was the most inventive musically and lyrically.The 70's Purple saw us listening to purple playing like a poor mans Sabbath,and why because he couldnt scream like a little girl.

I think its tuned around F. E, well its sounds close, but it isnt quite that low. Still, its awful. If Rod had been on In Rock, Fireball, or Machine Head, those albums would have been horrible. He was no rock singer.

Three of the musicians you see here in this 1980 Deep Purple video were also in a "bogus" Steppenwolf band in 1979. In this 1980 bogus Deep Purple video, the lead guitar is Tony Flynn, on keyboards is Geoff Emery, and on drums is Dick Jurgens... all were playing together in a bogus Wolf the previous year.
I heard the same promoters were behind the fake Steppenwolf, but didn't know some of these guys were also involved in that. At least Rod Evans actually was in Deep Purple at one time, but this was still disappointing and a ripoff. Definitely the worst concert I ever paid to see,

That was a fucking Disaster. I've heard Garage Bands do a better version than that. I'm surprised the crowd didn't riot. I know they did in Quebec when The Bogus Purple Played there. Sad That Rod Evans had to get involved in this. Trying to Cash in on Purple Success after he was kicked out. I read that at one show he actually introduced BURN as "A song from OUR Burn Album".
The third deep purple album was one of the best in my opinion...and sadly we'll never hear those songs anymore....let me remember just one title....APRIL!
owen, if you know your Purple you can't be serious, Evans had no rights to the name and was sent walking, never to return and the DP we all know and love to this day flourished for nearly five years before splitting, the definitive DP, undeniably. What they do now is respectful of the legacy, I assure it.

In Summer of 1980 I bought tickets at the old Ticketron for a show at the old DC area Capital Centre. The new Deep Purple was going to open up for the Joe Perry Project. I think this show was cancelled about a half hour after we got the tickets. I always wondered what story was and how this scam was pulled off. Rod Evans was good in Capt Beyond, he really f...d up getting involved in this, even though a lot of bands have done the same.

Whilst the whole thing was a ridiculous exercise and clearly a con, I don't know why everyone says there were no original members, as Evans *was* an original member of Deep Purple!
Also, according to the trial documents in 1980, there must be at least four 'original' members, in order for the band to be entitled to use the Deep Purple name, yet there are now only three - Paice, Gillan & Glover - who can claim to be original (and, as titustiti says, only Paice is really an original member!).
You don't get it, there were four mkII members in the band that Ritchie left, now only three but no break up occurred in order for the three to get back together and call it DP, which is how things just turn out when you stay together and someone retires but the others feel like carrying on. You don't stop and then try and come back with less original members later, which is what they would be doing if you were right.
I still have my ticket from the show they booked in Portland, had to save it.
The management people who set this up were the real villains. Evans was made the only shareholder, which meant he was the only one who could be sued. He was bankrupted by the real Purple and no longer gets royalities from the first three Purple albums.
@olhole It is a crime because one of the founding members who had nothing to do with the band since the late sixties decided he could use the name without any of the others, and without permission from any of the original members that had been going with the band until it's breakup. The current lineup of Deep Purple is not a crime because there's one original member still present, and he has been consistent throughout all of the lineups. Igualmente los tres primeros albumes de DP son geniales y nos regalan canciones como Anthem donde la Rod Evans se sobra de calidad. Yeah they really fall apart after the organ solo, It's sad that Rod Evans got so tied up in this (after all he can't be labeled an impostor) I've always found Purple's first three albums to be their most challenging, and Captain Beyond was awesome. It's just sad that this fiasco is (most likely) the last chapter in his career.

@kurtisthall65 There is a major difference in that Tony Iommi was a continuous presence in Black Sabbath, whereas Rod Evans was a member of Deep Purple for about two years before being replaced by Ian Gillan. The law's the law, but it's obvious Iommi had more of a leg to stand on than Evans' did. Also, Blackmore had been out of the band before they broke up so if any of the band members owned the name it would have been Paice and Lord at that time.

My first rock concert was seeing this fake Deep Purple somewhere south of Boston, MA in the summer of '80! I knew it only featured original vocalist Rod Evans but still it was a big deal to me as I was only 17 and never saw anyone famous up to that point. But watching this footage it is painfully apparent this was a travesty compared to the real deal!

I suppose the worst example of a fake band was the fake Fleetwood Mac which featured literally no one who had ever been in the band.

Estuve en este concierto con la ilusion de ver a Deep Purple. La banda que toco antes de ellos fue Black Oak Arkanzas. Jim Dandy trajo a un chavito de 16 años en la guitarra que tocaba de pocamadre. El Pinche Jim Dandy no paraba de decir "que bonitas Señorritas" Yo no veía ninguna, sólo vi pura banda mugrosa colgada de las porterias de Futbol Americano. La entarda fue un desmadre hubo portazo destruyendo las rejas de entrada. Al final todo un desmadre.

Rod Evans was an original member and was the vocalist before Ian Gillan, he sang on their first three albums, and they were a big artist in the USA whilst he fronted them.

He'd already left the real band in the seventies and had been replaced by Tommy Bolin, the real band even released an album without him before breaking up, Ritchie Blackmore's absence is irrelevant. What is relevant is the absence of Ian Paice and Jon Lord, who were the continuous founding members upon Deep Purple's original breakup, had they joined the project Rod Evans could have fairly asserted that it was Deep Purple.

Even the forfeiting of future artist royalties(for the first 3 Deep Purple albums) didn't recoup the enormous legal expenses of HEC Enterprises(Deep Purple's 1968-76 management) in suing the fake Deep Purple or satisfy the damages awarded to HEC by the courts. If Rod Evans ever attempted to make music again, any and all profits would be confiscated(by the courts) to satisfy his debt to HEC. His retirement from music isn't voluntary. It's enforced.

Neither Rod Evans or Nick Simper could sue for royalties from the CD reissues of the early Deep Purple recordings. After Nick Simper was fired by the group, he sued the group, and in the resulting settlement, he forfeited future artist & publishing royalties in exchange for a £10,000 lump sum. Rod Evans continued to receive roughly £20,000 per year royalties, until he started the fake Deep Purple. In the settlement of the fake Purple suit, Evans forfeited future royalties.

Rod got sued and lost he didn't have money to pay lawyer bills for Purple so lost all his royalties from first 3 albums. He then vanished and hasn't been heard of in 30 years. Some have stated that he is a nurse in San Francisco area but really, he's probably retired by now. When he was first ousted from Purple he had just gotten married to a rich lady. Nicky took cash in lieu of royalties and regrets it to this day. Love to see MkI reuinion with Rod and Nicky, Ritchie, Jon. It could happen.

Truth is, now Rod could easily front a band called Rod Evans' Purple (or similar), and no one would object. In 1980, tribute acts simply didn't exist. Also, Deep Purple themselves had a Number 1 compilation album that year (Deepest Purple), despite their having broken up. So the band was as big as ever. I also feel very sorry for Rod, who is a talent in his own right.

If Rod would have been smart, he would have let go of his saying of old soldiers never die and continue on with his success as a heart surgery director. I sorta tolerated his work for Deep Purple, I really liked the amazing job he did for Captain Beyond but reforming a band that he got voted out of after a long time without signing ever since the Captain Beyond break up in the early 70s, a few random musicians sure did make a huge disaster... As if he did that!

@thevinnymaster - I have to disagree. He should have been sued for doing this, he and the promoters who put it together. They didn't put a gun to his head (did they?) It was a total ripoff. Five years later the Mk 2 band got back together for real, and it was 100 times better than this. This is actually worse than I remembered.
I understand the same promoters put together a bogus Steppenwolf even before this (not that John kay and Steppenwolf are the real deal).

I remember being young and stupid; going to a dive south of Longview, Texas, because STEPPENWOLF was playing there!! And it was probably the same guys in this band, except they found some guy who could snarl and sing to be "John Kay."

I agree, and I must note that I was playing devil's advocate in my previous comment. It's a shame this ever happened, because Rod Evans was a damn fine singer in his own right, just not comparable to Ian Gillan.
If this was today, Evans would've done the wise thing and started a group with Simper and three solid backing musicians and called it something like Shades of Purple, playing songs from the first three albums.
I know I would've wanted to see a show like that.

Yes, the current Deep Purple and the previous MK.7 was/is great. Not many bands has kept it going for 42 years, even though they had a break from 76 to 84. Gillan's voice is not what it used to, but he sure can belt out most of the classics. He did 'Speed King' excellent in November last year when I saw them. They also look so happy on stage.

Silver is right. Rod was approached by a management company which specialized in questionably-reformed bands with big names and began to tour under the Deep Purple name accompanied by unknown session musicians. Rod just went with it and he got screwed over. He had to pay a huge fine and he no longer gets money from the 3 records he recorded with Deep Purple. Its a shame the management company didn't get fined or anything. Rod did nothing wrong and he shouldn't of got blamed for all this.

Rod was cheated into this. This concert promotor guy got away with it. Stop flaming Rod for it. Rod took the heat for this. Rod will still be THE original Deep Purple singer and frontman in the 60's, and the music they made on the 3 first album (and covered for that matter) are top notch. Gillan is was and still is my favourite vocalist, but Rod comes as a good #2. I'm glad this was documented, even though it wasn't very well performed. Would love to hear 'Hush' etc. which they also played.

Three of the musicians you see here in this 1980 Deep Purple video were also in a "bogus" Steppenwolf band in 1979. In this 1980 bogus Deep Purple video, the lead guitar is Tony Flynn, on keyboards is Geoff Emery, and on drums is Dick Jurgens... all were playing together in a bogus Wolf the previous year.

I heard the same promoters were behind the fake Steppenwolf, but didn't know some of these guys were also involved in that. At least Rod Evans actually was in Deep Purple at one time, but this was still disappointing and a ripoff. Definitely the worst concert I ever paid to see,

That was a fucking Disaster. I've heard Garage Bands do a better version than that. I'm surprised the crowd didn't riot. I know they did in Quebec when The Bogus Purple Played there. Sad That Rod Evans had to get involved in this. Trying to Cash in on Purple Success after he was kicked out. I read that at one show he actually introduced BURN as "A song from OUR Burn Album".

owen, if you know your Purple you can't be serious, Evans had no rights to the name and was sent walking, never to return and the DP we all know and love to this day flourished for nearly five years before splitting, the definitive DP, undeniably. What they do now is respectful of the legacy, I assure it.
Btw folks, I know where Mr.Evans lives, something many would like to find out.

In Summer of 1980 I bought tickets at the old Ticketron for a show at the old DC area Capital Centre. The new Deep Purple was going to open up for the Joe Perry Project. I think this show was cancelled about a half hour after we got the tickets. I always wondered what story was and how this scam was pulled off. Rod Evans was good in Capt Beyond, he really f...d up getting involved in this, even though a lot of bands have done the same.

Whilst the whole thing was a ridiculous exercise and clearly a con, I don't know why everyone says there were no original members, as Evans *was* an original member of Deep Purple!
Also, according to the trial documents in 1980, there must be at least four 'original' members, in order for the band to be entitled to use the Deep Purple name, yet there are now only three - Paice, Gillan & Glover - who can claim to be original (and, as titustiti says, only Paice is really an original member!).

You don't get it, there were four mkII members in the band that Ritchie left, now only three but no break up occurred in order for the three to get back together and call it DP, which is how things just turn out when you stay together and someone retires but the others feel like carrying on. You don't stop and then try and come back with less original members later, which is what they would be doing if you were right.
I still have my ticket from the show they booked in Portland, had to save it.

The management people who set this up were the real villains. Evans was made the only shareholder, which meant he was the only one who could be sued. He was bankrupted by the real Purple and no longer gets royalities from the first three Purple albums.

Deep Purple 2008.....going on 2011 is NOT fake.
They grew out of pervious Deep Purple lineups
that were legitimate, with studio albums to their name.
Steve Morse has been with dP since 1995,
and Don Airey since 2002.....
That's what they call evolution, dude.

@olhole It is a crime because one of the founding members who had nothing to do with the band since the late sixties decided he could use the name without any of the others, and without permission from any of the original members that had been going with the band until it's breakup. The current lineup of Deep Purple is not a crime because there's one original member still present, and he has been consistent throughout all of the lineups. Ian Paice should be allowed to carry on with Gillan and co

Me gusta la voz de Rod Evans, pienso que no luce o no se aprovecha lo suficiente en Captain Beyond. Igualmente los tres primeros albumes de DP son geniales y nos regalan canciones como Anthem donde la Rod Evans se sobra de calidad. Lo de México no fue una buena idea, pero bueno, seguro que quienes asistieron estarían informados desde antes sobre la formación; esto pasa con otras bandas célebres, Yardbirds y los mismos Iron butterfly entre otros. Yo igual hubiera asistido.

Yeah they really fall apart after the organ solo, It's sad that Rod Evans got so tied up in this (after all he can't be labeled an impostor) I've always found Purple's first three albums to be their most challenging, and Captain Beyond was awesome. It's just sad that this fiasco is (most likely) the last chapter in his career.

This is the reason why Rod Evans didn't get to sing on the classic Purple albums, like In Rock, Fireball, Machine Head etc. He's more like a pop singer.
This bogus shit was a BIG mistake from start to finish, and was the final nail in Rod Evans' "musical coffin".
