It's the same song. Christina took pieces of this tune and spliced it together to make a new song out of it. I'm highly doubtful that they tried to get away with it, I'm sure it's just an accidental failure to give rightful credit, and I'm sure it's not christinas fault, I don't think she writes her own songs anyway.

There are some very strong similarities in places. Yes, putting myself in the shoes of this band, I would feel that somehow, someone was influenced by this song subconsciously or not. I'm guessing Christina will probably end up having to include them somehow in the credits of her song. At the very least list their song as inspiration, and give whatever appropriate compensation the court desides.
