  • Marriages licenses are issued by the state, not by churches. Church weddings are purely ceremonial. A marriage doesn't have to have the approval of church authorities in order to be considered legal OR sacred.  State policies are not binding on church teachings, and vice versa.

Sorry but "preserving traditional union, purposes, and marriage" is exactly what the judge called it: a tautology.

    Marriage was not a christian label. It was a state contract to bind two peoples under law, which churches intertwined religion into, which is fine. The bible doesen't even mention the word marriage, and if someone believes two men shouldn't be married because of religious aspects, they should be thrown in jail, by the statndards of the law, as there is supposed to be a legalized seperation between church and state.

  • Churches opposed to same-sex marriage would not have been forced to perform such marriages in the absence of Prop 8 any more than orthodox synagogues are presently forced to perform marriages for Jews who intermarry. Moreover, it is rather disingenuous to argue that the only way to prevent an organisation from being forced to marry a couple is to make it illegal for that couple to be married at all.
