All waters in Montana are considered "navigable waterways" and are open to the public. However many land owners make it as difficult as possible to access the water. It's a continuing battle in MT, since many discovered flyfishing after "that" movie came out and wanted to cut a piece of the water out for themselves.
Definitely not....The water that passes over the land is public but the actual land itself can be owned in the same fashion as land for a home...I can't think of many rivers that have all public accessible water on them...there are definitely stretches but an entire river is highly unlikely....
