  • We as railfans must band together to support the effort to restore Amtrak service between New Orleans and Orlando. The government cant simply let Amtrak "indefinitely suspend" this service forever! Let's do something about it. Contact your senators and/or Representative now. Don't let your voices be unheard!

  • This woman never stops the truck or that red Grand Am. Plus she never once ever signals any of the traffic to stop. She doesn't know what she is doing at all.

  • The truck driver is not at fault. Most people don't know what this woman is doing. If the gates are up and a train isn't moving people are going to drive across. Not everyone knows what that woman is doing. She isn't using hand signals at, just standing there. You railroad knobbers need to get over yourselves. And if you watched the whole video you notice the gates were working fine.

  • She had a red flag in her hand and he didn't even slow him down!!!  Does he drive the same way in construction zones? Everyone else seemed to get it, they stopped. Also, the train blew its horn three or four times!!! This guy would fail the commercial driving test in every state!

    Ohh, and let's not forget why the gates weren't working in the first place, a trucker who has no place behind the wheel ran into them making an illegal turn!

  • My man used to flag crossings, with or without electronic crossing protection The Flagman/Conductor has absolute control of the crossing, all vehicles must follow the orders of the flagman. If they cut out an active crossing by manual control or circuit time out , The flagman was sent to assure that crossing protection reactivates before the train moves to prevent accidents, probably the reason the train stopped was a passenger stop. Conductor did not take control of the crossing.

  • Also: I wrkd on the GN here out west during college summers; I flagged Many a crossing; I wasn't evr trained as to a specific signal or posture or ? to tell motorists not to cross; it was somewhat 'play it by ear'....Train Stopped = No Danger.

  • apparently the train was at a regular passenger stop (Depot seen in background); for some reason (local law? , closeness to the crossing?) the brakeman (?) was doing his job! People (with lotsabucks) can rent a private RR car & pay Amtrak to tow it...Nice Way to travel!

  • Folks, if you don't know how railroad Track Circuits work, you are wasting your time commenting here. The Amtrak train approaches the crossing, the bells, lights and gates are activated, THEN the train stops. WHY? We don't know. Then, the bells, lights and gates are deactivated (the Track Circuit went into "time-out." So, why did the Amtrak person (Conductor?) get off the train to flag the crossing? WHY! The warning devices were working! The truck driver did nothing wrong! He stopped!

    Ignorance of the law is no excuse, but count me as one of the the ignorant. Not in any driver's manuals I've studied. Wouldn't know a train conductors uniform from a Quicky Mart uniform as never been on a train. OP, that would be a pretty confusing series of events for 99.999% of modern era drivers, you have to admit. Still, I think I'd have waited if I were the semi, but not enough info to to blame him for not doing so.

  • If you want to make rail passengers pay what it ACTUALLY costs, then let's play that game across the board. Do you delude yourself that the price of your airline ticket pays the costs of that plane? HAH! What about the air traffic control system, the airports themselves, the airport maintenance, etc., etc., ALL paid for with tax money. Railroads pay for their own rights-of-way, every rail, every switch, every signal. You can't say that about planes. Amtrak is a BARGAIN!

  • As a public service announcement to those in Minnesota, the law states:

    It is unlawful in Minnesota for a motorist to move over a highway-rail crossing when a flagman is signaling the approach or passage of a train. Motorists are prohibited from driving a vehicle past a flagman until the flagman signals that the way is clear to proceed. Minn. Stat. § 169.26(c) (1999).

Every single one of their routes has gone up in ridership due to the high gas prices and airline fees that started back in 2006. Amtrak has seen a boom in ridership so please know what you are talking about next time. This route here the Empire Builder is Amtrak's busiet long distant route and stay packed.

  • @jmiersmasexy - Tracks have sensors on them so that dispatchers can tell where trains are, and to alert if a train derails. Deploying a conductor to visually monitor the train's wheels as it slowly passes a crossing is a safety protocol mandated when the sensor at a crossing is broken. Think about it, a train stuck across a road would be extremely bad. Better safe than sorry!

  • From the video I seen nothing the truck driver could have been prosecuted for. This just shows a failure in the part of the woman, some failure with the driver and a failure of the justice system. If she wanted him to stop, all she had to do was wave that flag of hers and maybe yell. She just stood there then moved thus giving permission to proceed. This video should have been presented in court.

Basic rule of the road, if someone's in the road -- especially with a red flag -- drivers are supposed to stop. The rules of the road don't specify that the flag must be actively waved, or even that a person has to HAVE a red flag in the first place! It's basic courtesy and common sense, commonly lacking on the road, and amply demonstrated in this thread...

  • @cobraman96 All of this nonsense did start under president Bush. Things are not great but I can certainly say that they are better than what Bush did. We are net gaining jobs instead of losing 700,000 a month under Bush. The unemployment rate does need to come down a bit and I believe it will but it will be a long way to recovery since it took 8 yrs under Bush to mess things up. Investing in infastructure is key and Amtrak should be a major part of that since ridership is UP!

  • the semi had no fault in this he stopped at the stop sign turned the corner and saw that the train was stopped and the person with the flag and she got out his way and let him through because the train wasnt moving yet so he had his time to get across

  • @TheKwtrucker Except that the semi did NOT have the right-of-way. There were other cars that did have the right-of-way that did stop to wait for the train. The semi had a stop sign.

  • @likestallwomen -- the gate controls seem to be set to prioritize auto traffic over rail safety. The gates raised - with almost *no* delay - when the train paused to deploy the conductor, even though it was still sitting right there, and was going to resume motion. The municipality probably pressured whoever owns the trackage to set the gate that way. This proves why such pressures need to be resisted, to prevent situations like this from even happening. Safety shortcuts = bad idea!

  • @TheKwtrucker The driver saw the flagman(or woman in this case) and did NOT have the right of way.Under new federal laws the driver lost his CDL for a few months if they prosecuted him which I hope they did.

  • @cavibird2005 Cars and trucks must alway yield to trains at crossings. The official charge is trespassing and failing to yield. If you disagree, you go to court and fight it. (ps., you will most likely lose. Not saying you always should, but you will.)

  • @paulgrem Amtrak rents the track from BNSF, How can Amtrak charge someone with trespassing on property they don't own? Also a red circle isn't a legal yield sign in MN. It would have to be white with a red outlining border to hold up in a MN court. Also She NEVER held up the sign. She stood there sign in hand.

  • I have never seen a situation like this, where the train stops, the arms go up, then a human stands on the roadway with a little red flag....the "conductor" wasn't even wearing a high-visibility workvest....very dangerous!

    I disagree with prosecuting the truck driver. The truck stopped before making his right turn. The train was stopped, the arms were up and someone looking like a civilian was standing on the roadway.

  • If anybody is to be prosecuted,it should be that conductor not enforcing safety. It was HER JOB to "wave the flag" that she had in her hand,and signal to the driver to stop. The stop arms were up with no bells or flashing red lights. She just stood there with an "I dare you stance and posture". The driver probably loses his job for doing his,and she keeps her job for NOT doing hers Typical with union workers. This video should be shown to the proper authorities then you will see who is at fault.

  • They should shut down the tracks until the gate was fixed, or use cones or other kind of barrier.

A conductor's usual duties are normally *inside* the train, taking tickets, etc. or in controlled environments of rail yards. How nice of you to defend the indefensible, and be insulting to a hard-working service professional in the bargain.

The fact is, the truck was in the process of starting his right turn when she walked onto the road. the trucker has to watch the traffic and his trailer in his mirrors and probably didn't see her standing in the road way until he was on the tracks... it kinda looks like she was CROSSING the road

If he's not paying attention at crossings, should he be driving? What if it was a signal malfunction and another train was speeding toward the crossing? Would he have seen that too? Ticket will keep him paying closer attention next time. The truth is that common sense has died apparently

  • I'm not from the US, but even then it is obvious that the truck driver was not at fault. The conductor could've waved the flag at him and made him stop but she just stood there watching until he passed by, then noted his number down and got him prosecuted. Nice video though. Love those P42DCs

  • The conductor did not give any type of signal until after the truck was already under the arms of the non-working signal. Even then, the conductor's signal was not definitive, at least from the camera's angle. I can't blame the trucker.

    Stupid thathey flagged the crossing when they could see that signals and gates were functioning OK. They could have proceeded and observed if gates were staying down and traffic stopped.

  • Even if they gates were working right the Amtrak crew had to follow protocol they had received word the crossing had been malfunctioning so even though the gates were down if they may be acting up it's procedure for a train conductor on a freight or passenger train to flag the crossing and make sure motorists don't cross

  • i think by the time the truck driver realized she wanted him to stop he was already on the crossing. most people don't usually look for a flagman on railroad crossings. I imagine seeing a train parked on each side of the crossing was rather confusing.

  • lol, I tried to put myself in the situation of a driver (having never seen this done before), and I'm pretty sure I would have at least hesitated if I saw a uniformed person standing in the middle of a crossing with a red flag.

    In the driver's defense, she could have been more animated with the flag. If I was her and I just stood there and then saw the truck continue to move, I would have started waiving the flag more (and I was waiting for that), but that's not what she did.

  • Wow that conducter did a very poor job flagging! When I flag on the TLE&W railroad I wear a safety vest, hard hat, and I use a very bright flag. She just did a bad job flagging! She did not even the semi to stop very well! Good video!

  • @metraF40PH163 Yeah, that one is a new one to me. I used to switch the NS line out of Ft. Wayne running the Defiance and Napolean. Long, long time ago. Lot's of grain and tomato paste. Track was terrible.

    Remember a lot of long winter shoves into a Cement plant. Can't remember the town. Derailed a caboose on a road crossing during a shove one day. Conductor was a newbie and scared the shit out of him. LOL. We pulled it back on in about 5 minutes but he won't forget it.

  • I volunteered at Steamtown years ago and the one crossing I was flagging a guy decided to by when I was in the middle of the crossing. I memorized his license plate and at the next block there was a cop and I told him it. A few days later the conductor I was working with that day told me that the guy a ticket.

  • Techinquely the train ran a stop signal. Any signal given with a red flag or anything red is a stop signal. Looks to me like a failed effiency test.

  • I agree that that flag could have been used better. And I know the GCOR 3rd ed (Thast my local musuem runs by) requires flaggers in orange vests for visibility, which I would of thought would be on the train somewhere. And it wouldv'e been nice if those gates hadn't timed out on her.

    On the other hand, what part of K5+person in uniform in the street WITH a flag at all Doesn't compute?

  • No.1 thing wrong there was, they sent a woman out to do a man's job. She shouldn't have gotten out of trucks way and should have thrown that red flag at the windshield of the truck! Stupid dumbass truck driver! People like that should be hit by a train.

  • That is really stupid! Number one, you don't drive across a rail road crossing if the conductor is there, and number two, when the engineer honks the engine's horn, you know you are doing something wrong.

  • she didn't say that this trucker bent the gate, but that a previous trucker had. The gates seemed to be working fine; why was the flagger even needed?

  • Because some people may think "oh ill be gone when the train gets here" or "the train is stopped, not a problem" but if a person is there, they can more effectively stop traffic.

    P.S.-can crossing gates file charges-no, didn't think so

  • I've timed it. The truck had cleared the gates 25 seconds before they started coming down again. As for the angle, that's how the gates were installed. I'm a retired RR engineer but will have to side with the trucker on this one.

  • I totally agree with "robertgift." The gates had timed up and the truck came nowhere close to hitting them. The stupid Baggagemaster just stood there like a zombie and never waved the red flag to try to stop the truck. I'd have done the same had I been in the truck or a 4 wheeler.Rockchickvw needs to stop lying about the incident if he's going tp post the video for all to see.

    I don't blame the trucker for proceeding.

    The signals were not operating and flagger was just standing there.

    The lowered gate was not even close to being in foul. I would have slowed but not stopped unless wind could blow gate closer to train. No wind.

    Why did you not push gate back while it was down?
