Sorry dude but your idea won't work at all since New York already taxes tobacco at an obscenely high rate. Everytime the tax goes up, revenue goes down since you drive more and more people to the reservations where it's more or less tax free. The other problem is tobacco taxes are as reggressive a tax as you can get and severely impact the middle and lower class...im not a smoker either but it's just wrong to use addicted people as cash cows.
The state of New York has tried this too on several occasions only to lose in court do to treaties that have been signed with the Native peoples, the only way it could ever stop is if the Indian's decided to close up shop. How about bringing back the poll tax/charging people to vote, that would raise tons more money...do you know if they ever made that illegal?

They need to make it illegal for shops on reservations to sell tax free to non indians.
