  • If mafia would do it to you it would be called extortion. When Bank charges you this is legal. Judge said this is core of the bank account bla bla. What???In any 3 world country if you go overdrawn you are charged interest + cost which is normally not more than £2.50. Why the hell nobody does anything about it?? Everybody knows this is f**** wrong!! Where is Mr Cameron?? Why cheapest credit card charges you interest a minimum 16.9% while interest of BOE is 0.5%?

  • @Martyboy2k6 Banks are here to lend money if I go overdrawn they should charge me their cost + interest which is normally no more than £2.50. They charge 28+ quid for going 5 quid overdrawn mafia would say banks have very good extortion facilities.

  • Furthermore, if LTSB's share prices over the last week are anything to go by, they may not have a company left soon, so any 'victory' on their part will be short lived. And it's getting close to election time, so Mr Brown will give them another handout and interfere in the charges issue - if he's as sure as the rest of us that he won't be winning next year's election.

  • How so, bidborough? All that was decided was that the OFT wasn't given the authority to decide on fairness of charges. That leaves the door open to decide who does. It still doesn't mean that the court has decreed that these charges are fair. Besides, the OFT has the right to appeal or structure a new case - even Lord Phillips said the latter.

  • No dcamaggots - The Banks have won. Even Martin Lewis has said there's only a 10% chance of winning if they persue using clause 5.

  • No they haven't. All it means is that the OFT don't have the authority to say what a fair or unfair charge is. That's not the same as saying that LTSB have won anything.

    All that's happened is the situation drags on as before, until the argument gets resolved one way or the other.

    Remember that the banks lost out twice in the two previous cases.

  • Sounds familiar to our family's situation. Im starting to really dislike Halifax...how come they have double charged me for being overdrawn? they allowed the first overdrawn sale, when it said i had the funds to spend, so i spent it, and went overdrawn a second time i mean WTF? so ill get a nice £35 charge for it. This ultimate reward account is a joke.

  • I agree totally. See my comments above. I am totally disillusioned with the Government for allowing tihs to contine for so long. We have all known about these practices for at least five years now.

  • Thank you for giving me a little hope that my battle against Lloyds TSB might eventually be won. I have been fighting them for 6 years after losing a job through stress and high blood pressure. Then I could not work for 10 months because I was nursing a relative who was dying. Lloyds just added charge on charge- £200 - £600 per month. I have engaged a solictor and written many letters about the financial hardhip I am in. Their responses are like something out of a novel by Kafka or Orwell.

  • Work this out, I was charged £39 a few years ago for a failed direct debit, fair enough, I had no money to cover it, so I let it go and just paid up.. A few months ago they charged me £35, and the charge was for 'Paid Item' ?? which took me overdrawn and they threw another £28 on top for it. So how come they can refuse payment one minute when you dont have the funds, then turn around and pay something for you, when you dont have the funds, and charge for both? Daylight robbery! HALIFAX

    I was OK with LTSB until I had a problem with their service, and then another problem developed from that, and then another...and so on.

    Up to now, LTSB have refused to refund my unlawful charges, but LTSB are notoriously arrogant when it comes to charges, so this isn't a surprise.

    But it does seems that the banks have lost the test case (announced today).

    Oh dear - my heart bleeds for them.

    Jan 2009 - Lloyds forfeits $350 million in the USA for breaking US sanction law by knowing pushing transactions through Iran and Sudan through the US banking system.

    Lloyds are fucking immoral hypocrites and should be put out of business.

  • The Bank does not owe you anything. A bank has the right to refuse to lend you money, & when you are refused an overdraft but still go overdrawn you pay the price because you lent the banks money when they had refused to lend it to you its a penalty to discourage this behavour The alternative to the penalty is amusing to me, the test case is actually still ongoing but if it does succeed it will only mean banks will bounce your payments instead then you can pay the other companies charges instead

    I agree with charges when its like say £30 over your overdraft but I got charged £35 12 months ago for being 52p overdrawn for a day, ok i got the charge back but 52p. I still have the letter to prove it.

    They constantly charged us with ridiculous bank charge letters that considering our situation was almost impossible to pay the first one, £20. What Lloyds and most of the other banks are doing should be classed as illegal, no ethical bounderies whatsoever and they play on peoples' stupidity or misfortune.

  • It costs more than 50p to managed overdrawn customers, you're right in that it doesn't cost £30. more like about £5/6 per day.

  • I fought the Barclays and won. I got £1987 back from them... and they paid the court costs too. Lets hope the current court case against the Banks wins so more can claim back what is rightfully theirs.

    I'm sorry but anyone who can ammount a significant amount of charges (say 1k+) is just stupid.

  • I used to have an account in America and the banks there don't even let you go overdrawn. They also charge you to have an account. At least it's free here as long as you stay within your limits.

  • True it sucks that you have to pay the to banks look after your money while they earn from it's interest.. but if you go overdrawn here at the moment(even a small amount) you're charged approx £30 for the pleasure..which coincidently is to be contested in court in January.. Power to the people!!

  • That isn't quite true. Depending on your bank, you can get an account that doesn't charge you fees for keeping the money in the account. WaMu (Washington Mutual) is one of the banks that does this. And, they will let you overdraft your account, but they will charge you a stiff fee for doing so, and if you do it too much, they won't let you overdraft anymore, so manage your money carefully. Best part of the US banking system is the FDIC insurance, which the UK doesn't have :)

  • So if a direct debit is taken out early for my phone bill a few days before I get paid, and is then charged properly a few days later when I do get paid (the total admin cost for my bank being around 50 pence)... they have a right to charge me £39 for it?

  • Going overdrawn you use other depositors money and the bank charges you interest, which is fine and fair. This issue is about the banks over charging customers. Charging them 30 quid for a service that costs 50 pence. They legally are not able to do so and that is why it is theft. The court case will show that, the banks know it and this is why they have always settle all cases out of court because they will be proved wrong if they ever went to court. You need to understand the whole issue.
