  • I always carry an id or licience. Late at night police do check people out walking around for various things including intoxication and other things people do late at night.

  • I live in Nevada, do they hav that particular id law here? I hav been stopped before, but only for various traffic infractions and that only 3 times in my 18 years of drivin, never for simply walkin down the street; this was really informative

  • all of the stops are legal. you have to identify yourself to law enforcement upon request no matter what the issue is. you have to at the very least give your full name, date of birth, and address

  • Unless your under arrest, you do not have to show ID, or give your name, d.o.b etc. That is a violation of his human rights, constitutional rights.

  • I will correct what I posted shall I. It is an infringment under US Constitutional Law, for the Police Officer to ask for ID if that individual is not under arrest. It is also against that individuals Basic Human Rights also, Under the UN Charter, whcih the US is a signatory to. But I forgot your country does not care about international law does it.

    there is NO law in California which requires you to provide identification to a police officer on demand. Of course, there are some specific circumstances where you have to have an ID, as when you are driving a vehicle.

    there is no general law making it an offense to fail to identify yourself to an officer. You cannot be detained, arrested, or searched MERELY because you do not identify yourself. It is, of course, an offense to give a FAKE ID, orally or a false card or certificate.

  • At the time of of this legal challenge, in San Diego, in California, and all across America it was Black, Brown and Young People who cops stopped and asked for ID - with no reason - no probable cause. Cops typically don't stop white folks and ask for ID to this day.

  • He didn't go the black route, each time he said black he added "brown or young" to the classification. This was not a typical case of, "Woe is me the black guy being put down by the man." This was well thought out and a good fair move. I for one applaud this guy because he never played the race card and said, "I'm so oppressed and everyone owes me shit and you're racist if you don't give it to me."

  • Dude, I grew up in California for the first 21 years of my life and spent roughly the first half in downtown Los Angeles and South Central (now South Los Angeles in an attempt to remove the stigma behind it), and I can tell you for a fact that no gang member I ever saw looked like him.

  • Think about this. A large percentage of African Americans are in the prison system because a larger % of the population is stopped by law enforcement. I'm not saying that no african americans are guilty, because some break the law, but if a larger part of your population is chronically labeled and targeted for criminal activity, then you are going to have a larger percentage of that population in prison.

  • He WON in the U.S Supreme Court. Since then Americans do not have to show their ID to law enforcement if they are a walking as a pedestrian. ID / Drivers Licenses are required for driving cars, not for Americans walking outside on a sunny day in American parks and sidewalks.
