Border Patrol is for the border between either Canada and the US. They should not be questioning anyone anywhere else after entering the US. Everyone should do what CheckPointUSA is doing. "Am I being detained? - Am I free to go?" When the people fear the government - there is tyranny. When the government fears the people - there is democracy. Know your rights. Those that comply and answer questions are giving these people free reign to impose a Nazi state.
some one should invent a cell phone application where once some one locates a check point that person can upload that information to everyone who has the app, and all app subscribers may take another route if they choose.

CheckpointUsa, domestic check points is a bit of an overstatement. Note these check points are placed in tactical positions, not your blvd next to the Mcdonalds & walmart you live next too. These roads have a questionable and rather high mix of traffic, both good and bad. Their presence alone acts as a deterrent, points that you seem to miss. The actual border has men present as well. I don't think these agents are there with a stop sign because the local arcade was closed for lunch.
I disagree MrReeze290. These checkpoints are setup away from the border or its functional equivalent well inside the United States where the majority of traffic is domestic in nature, not border. Many have been setup along East-West highways that never intersect the border at any point where the majority of traffic is local commuters trying to go about their daily lives. This despite there being plenty of places to setup checkpoints where the vast majority of traffic is indeed border-related.
Regarding your claim of deterrence, they're not MrReeze290. In 2008, there were approximately 3,000 BP agents in the Tucson sector & 265 miles of border. 10% of BP personnel were assigned to internal checkpoints where they averaged 6 illegal alien interdictions/agent/year. The remaining agents, not seizing domestic traffic, averaged 118 interdictions/agent/year. No comparison in effectiveness. More illegal border crossers would have been interdicted if agents weren't harassing domestic traffic.
Sorry, if that sounds (reads?) a bit offensive, but.. no, the question is not if you can do that in all checkpoints. The question, or rather, the QUEST is for all to realize the true boundaries of legal system and understand the legal meaning of "the person" and "the agent" and "the statute" and so forth. You can clearly see that after a run around of questioning, they do nothing more and allow him to go. They do not have this authority. They are giving it to themselves, and this is not right. Driver license is always required to drive... hence you will always have ID if you are stopped at a road block. Common sense requires you carry ID, especially if you are in an accident.

One thing I note.....in the descriptions of the video and sometimes verbally, you keep maintaining that "they know who I am". But not once have I heard you offer to any agent any identifying information. I know that that is your point and you are free to do so, but you can't quite fairly use the idea that "they know who you are" if you've never established who you are. I'm caught. Additionally, Edward Tuffly the head of the local BP Union at the time had filed several written complaints with my work, state law enforcement & Russell Pearce in the AZ legislature in an attempt to get me fired, arrested, etc. Failed on all counts but they definitely knew who I was.

I'm not concerned about being charged with anything scrm1. I'm concerned that any overly zealous agent who doesn't know what the definition of detain is will shoot me in the back if I leave without them making it perfectly clear that I'm free to go. As I stated before Texashog74, my videos deal with 4th & 5th amendment violations by armed federal agents seizing people at internal checkpoints no where near the border they're being paid to patrol. My videos have nothing to do with border security, illegal border-crosser interdiction or internal immigration enforcement. Government isn't about the ends. It's about the means & any means that violate explicitly recognized Constitutional protections are unacceptable.
Additionally Texashog74, I've already addressed your questions dozens of times. If you had bothered researching my blog, website & the comments I've made on these videos, you'd already know that. With over 3,600 Border Patrol agents in the Tucson sector & only 265 miles of border, there's no reason why the BP couldn't secure the border at the border. These internal suspicionless checkpoints are nothing more than dog & pony shows designed to create the illusion that CBP is doing something useful.

They do 10hrs on and 12 hrs off roation matrics so that means around 450 agents on the ground. Concidering they travel in groups of 2-3 that means between 270-230 field teams at one time.

What you failed to mention is the force multiplying factors associated with remote sensors & cameras, fixed & rotary wing aircraft, unmanned drones, satellite technology, night vision capability coupled w/radar tech, virtual & real walls, etc. You also failed to mention the recent 2 year GAO study that revealed how much more effective border ops are in comparison to internal checkpoints. 20x more effective based on numbers from the Tucson sector in 2008
Specifically Texashog74, the GAO report revealed that 10% of the 3,000 Tucson sector BP agents in 2008 were used at 1 of 13 internal checkpoints within the state. 9 checkpoints were operational at any given time. Each checkpoint agent averaged ~6 illegal alien interdictions per year for 1,800 total while all other BP agents averaged ~118 for roughly 318,000 interdictions.
The numbers from the report make it clear that border ops are far more effective than internal checkpoints.

It is the duty of all people in the US to assert their rights. In order to sustain our rights, we must actively exercise them. In this case, he is asserting his rights, including the Miranda Rights and the 4th and 5th amendments. That is why it is important to use these rights whenever we can. Here, he used his rights effectively while being courteous.

I've written extensively about this on my website dklilm0mma. SCOTUS has only upheld limited scope suspicionless checkpoints for public safety purposes while striking down checkpoints with a primary purpose of law enforcement or drug interdiction. DHS routinely ignores the limitations imposed on such checkpoints in order to conduct general law enforcement dragnet ops which are illegal. Actually atdi345, roadblocks can only be set up for very specific & limited purposes. In fact the SCOTUS explicitly ruled general law enforcement & drug checkpoints to be illegal in City of Indianapolis v Edmond & significantly limited the scope of immigration checkpoints to very brief immigration queries with any further detention or searching requiring consent or probable cause in U.S. v Martinez-Fuerte.

Border Patrol is for the border between either Canada and the US. They should not be questioning anyone anywhere else after entering the US. Everyone should do what CheckPointUSA is doing. CheckpointUsa, domestic check points is a bit of an overstatement. Note these check points are placed in tactical positions, not your blvd next to the Mcdonalds & walmart you live next too. These roads have a questionable and rather high mix of traffic, both good and bad. Their presence alone acts as a deterrent, points that you seem to miss. The actual border has men present as well. I don't think these agents are there with a stop sign because the local arcade was closed for lunch.

I disagree MrReeze290. These checkpoints are setup away from the border or its functional equivalent well inside the United States where the majority of traffic is domestic in nature, not border. Many have been setup along East-West highways that never intersect the border at any point where the majority of traffic is local commuters trying to go about their daily lives. This despite there being plenty of places to setup checkpoints where the vast majority of traffic is indeed border-related.

In 2008, there were approximately 3,000 BP agents in the Tucson sector & 265 miles of border. 10% of BP personnel were assigned to internal checkpoints where they averaged 6 illegal alien interdictions/agent/year. The remaining agents, not seizing domestic traffic, averaged 118 interdictions/agent/year. No comparison in effectiveness. More illegal border crossers would have been interdicted if agents weren't harassing domestic traffic.

The question, or rather, the QUEST is for all to realize the true boundaries of legal system and understand the legal meaning of "the person" and "the agent" and "the statute" and so forth. But not once have I heard you offer to any agent any identifying information. I know that that is your point and you are free to do so, but you can't quite fairly use the idea that "they know who you are" if you've never established who you are. I'm caught. Additionally, Edward Tuffly the head of the local BP Union at the time had filed several written complaints with my work, state law enforcement & Russell Pearce in the AZ legislature in an attempt to get me fired, arrested, etc. Failed on all counts but they definitely knew who I was.

CheckpointUSA-I live in El PASO, TEXAS and usually have to pass through these drug and citizenship temporary detainment stations when ever I want to leave town. When ever I pull up to the agent I just remain quiet or mumble. First words out of their mouth is pull into lane 1 sir. Thank you for your inspirational videos because now I will try your tactic on them. They were very rude to my girlfriend for no reason.

Do you know for each agent it takes 4 to support that one field agent? so your 3600 agents is more like more like 900....concidering agents dont patrol for 24hr shifts. They do 10hrs on and 12 hrs off roation matrics so that means around 450 agents on the ground. Concidering they travel in groups of 2-3 that means between 270-230 field teams at one time.

What you failed to mention is the force multiplying factors associated with remote sensors & cameras, fixed & rotary wing aircraft, unmanned drones, satellite technology, night vision capability coupled w/radar tech, virtual & real walls, etc. You also failed to mention the recent 2 year GAO study that revealed how much more effective border ops are in comparison to internal checkpoints. 20x more effective based on numbers from the Tucson sector in 2008

Specifically Texashog74, the GAO report revealed that 10% of the 3,000 Tucson sector BP agents in 2008 were used at 1 of 13 internal checkpoints within the state. 9 checkpoints were operational at any given time. Each checkpoint agent averaged ~6 illegal alien interdictions per year for 1,800 total while all other BP agents averaged ~118 for roughly 318,000 interdictions.
The numbers from the report make it clear that border ops are far more effective than internal checkpoints.

It is the duty of all people in the US to assert their rights. In order to sustain our rights, we must actively exercise them. In this case, he is asserting his rights, including the Miranda Rights and the 4th and 5th amendments. That is why it is important to use these rights whenever we can. Here, he used his rights effectively while being courteous.

Remember! A police officer's job is to FIND, ARREST, and CHARGE people. Whether or not you didn't do anything wrong is not for you to decide. That's why its best to remember your rights and sometimes. Its better to keep shut and practice your rights. Besides, is it really cool to get charged for not having ID on you when your walking down the street? Did you know that its illegal to provide, have ID in Canada, Ontario? Imagine all the innocent people charged for small peanuts. (Ex. G20 Summit)

A legitimate question I have: In the same manner that field sobriety checkpoints have been held constitutional (for whatever the reasons were), haven't these border checkpoints also been held constitutional (for whatever the reasons are)?

I've written extensively about this on my website dklilm0mma. SCOTUS has only upheld limited scope suspicionless checkpoints for public safety purposes while striking down checkpoints with a primary purpose of law enforcement or drug interdiction. DHS routinely ignores the limitations imposed on such checkpoints in order to conduct general law enforcement dragnet ops which are illegal. People like the douche who made the video are doing nothing but wasting time and resources. Checkpoints are setup near the border, along roads that are known to have traffickers travelling them, to check citizenship. And yes, 40 miles is near the border.

@mick2cu: An officer's job NEVER includes violating people's constitutional rights, such as the right against unreasonable searches without a warrant, or the right to remain silent. Officer's should be trained how to deal with such people: quickly let them go on their way.

Actually atdi345, roadblocks can only be set up for very specific & limited purposes. In fact the SCOTUS explicitly ruled general law enforcement & drug checkpoints to be illegal in City of Indianapolis v Edmond & significantly limited the scope of immigration checkpoints to very brief immigration queries with any further detention or searching requiring consent or probable cause in U.S. v Martinez-Fuerte.
Are you starting to see the point now or do you need something more blunt to focus on?

How do people not realize that this is not how America is supposed to be. This smacks soooooo disgustingly of Nazis asking to see papers in occupied territories. Land of the free? Not particularly. Home of the brave? Perhaps, if others have the bravery to exercise their basic rights.
Though one has to love the prototypically American attitude of the officer, weighing if the extra work he is going to have to go through to detain the author is worth it. Then the eventual 'aw screw it move on'

An educated public would know we do not need our "papers" to travel freely within our own country.
