Constitutionally speaking, originally, people would be right, but with the Union having won Civil War, the constitutional definition was changed (changing it is also constitutionally applicable, with or without a war to make it happen), so that state trumps local, and federal trumps state. Ergo, any assumption of rights outside or above those given by federal law is, technically, unconstitutional.
