If he wasn't driving anything but just riding, than it isn't illegal to just ride in or on a vehical drunk as long as your not in control. In this case his defense can be that well at least the horse was sober and was the one in control and the man was just a passanger. I remember cops even told me that I can get a DUI on a bicycle even though a bicycle is not a motor vehical. Then I heard one time that if you're caught drunk on a bicycle, you wouldn't get a DUI but you would get a BUI.

So say you are having a party at your house minding your own business and the cops are called. Everyone at that party who is "Above the legal limit" can be charged with a DUI even if they arent even riding a tricycle with a lampshade on their head. I learned this the hard way.
