  • I just want to let everybody know that I am so greatful that Illinois Senator Mark has replyed to an email that I sent to him about PIPA and SOPA. Unlike Congresswoman Jan Schakowski she has not said anything. I think PIPA and SOPA are going to destroy first amendment of the constitution of freedom of speech.

    That isn't what the statement says at all, shithead. It says that Congress can pass any laws that it deems necessary, provided that they don't violate the rest of the constitution. You can make some sort of archaic States' Rights argument, but when the founding fathers actually were in Government, they used that clause to pass laws that you'd probably deem unconstitutional.

    The existence of the state in itself throws away freedoms. That doesn't mean I want to immediately abolish it. Look, I don't like the health care bill. I don't like Jan Schakowsky. I don't like Democrats, and I don't even like the Constitution. But this argument that it's somehow unconstitutional is horseshit.

    It's the clause that the Supreme Court has used to justify everything from Child Labor Laws to Social Security. I can't argue anymore, because it's just a sheet of paper.

  • @00maharum00ma Ok, so Article 1, Section 8, Clause 18 basically says that Congress has the authority to execute laws within the framework of the Constitution... which has absolutely nothing to do with the ability to mandate consumer purchase. There is also a massive difference between Congressional authority and Supreme Court's interpretation Constitutional law.

    I am sorry this is just a piece of paper to you. For many of us, the Constitution is the writ that all of our freedoms are based on.

  • A person who has taken an oath to uphold the constitution shouldn't use the fact she doesn't think the constitution allows for medicaid/medicare as justification for passing more laws she doesn't believe the constitution allows for.

  • @fdmille Actually, that's within the Sixteenth Amendment. The interesting thing is, the tax must be "without regard to any census". So, if the census asked questions regarding income then it could possibly be used to argue taxes changing with income levels is unconstitutional. What's more interesting... when that amendment was written, it was considered including a three percent limit for the maximum income tax. It was decided against fearing the tax would be maximized right away. Sigh...

  • Excellent reporting. It is important for the voters to known who Jan S. "really" is. People in her district view her as a hard worker who brings home the bacon. In reality, her and her husband are influential among the far left socialists who have a hand in the destruction of the once proud city of Chicago.
