If this was a Republican organization, the studios would have already submitted copywright infringement claims, and it would've been yanked in quick fashion.
Maybe that only happens when the ad's creators fail to get proper permission to use copyrighted work - like when McCain's campaign used Jackson Browne's "Running on Empty" w/o his permission.
Being a Democratic or Republican ad doesn't matter - being one that uses material with permission or not does.

In the case of Heart and "Barracuda", the Reps had purchased those rights (can't speak for the other singers). Heart whined about them using it, but their contract, unlike some other artists, didn't specificaly deny the ability of political organizations the right to license the use of the songs.
