Proposition 8 is about preserving marriage; its not an attack on the gay lifestyle. Proposition 8 doesnt take away any rights or benefits of gay or lesbian domestic partnerships. Under California law, domestic partners shall have the same rights, protections, and benefits as married spouses. (Family Code § 297.5.) There are NO exceptions. A domestic partnership under CA Fam Code 297.5 IS THE SAME. Tax/Federal benefits happen because children are present or created from the union, dumb one.
shiftfallout, there are significant differences between the benefits and responsibilities of marriage and civil unions. People who are married usually enjoy more benefits than those in civil unions, including:
- Legal recognition of the relationship in other states
- Ability to divorce in any state, regardless of where married
- Tax benefits available to married couples only
- Immigration benefits when petitioning for a non-citizen spouse
- Federal benefits, such as medical and life insurance
Above all, I consider the biggest difference between the two as the fact that they are two separate entities. To give one set of rights to one group and another set of rights to both groups creates separation and division. There is historical precedence in the US whereby separate is not considered equal, especially in the Brown vs. Board of Education case when the US Supreme Court stated that "separate educational facilities are inherently unequal."
Tax Benefits are available to married couples via children bud. The benefit thats different from homosexual partnerships, involves actually having that child, thus the tax information changes via tax form. All benefits are linked to children. If you want legal recognition in other states, then there needs to be a push for the union in those said states. The issue is about California though and its constitution. In california, equality is already there, dont play dumb please.
Civil Unions are not recognized by the federal government, so couples would not be able to file joint-tax returns or be eligible for tax breaks or protections the government affords to married couples.
So if the state will not recognize gay marriage the federal wont.
also Immigration Divorce and gay do adopt as well as straight people. but even the their are differences.
and i don't think you are dumb i just don't think you understand this issue.
Equality? You mean... California Fam Code 297.5 which states that everyone has the same rights. Which they do. Hey heres an idea, lets feel special and get special treatment, lets ignore the 2000 vote on the same issue, and force 5 year olds to be taught homosexuality. If the same rights are being given, why continue fight? 1. Because they are not educated nor logical. 2. Its really about being special, not equal. 3. They dont realize the effect this would have with how the middle east sees us.
who gives a shit what the middle east thinks of us. are you the American Taliban? prop 22 was unConstitutional, and prop 8 will go the same way. marriage is marriage. period. get over yourself and learn to share. and start acting like an American for God's sake, and fight for freedom and justice for ALL American citizens!!!
It is not the same. A civil union is different from a marriage. Two of the difference are
Federal Benefits
Taxes & Public Benefits for the Family
