Actually you can officially assume w/e you want as that is the official stance of Capcom as they want everyone to be happy, but the original intent was for her to be female only. There is an entire official interview with Ono specifically on her gender.

Poison belongs with the group of Street Fighters whom first appeared in Final Fight later appearing in Street Fighters. Characters such as Guy, Cody, Maki and a few others i believe.

Eh... my problem with Poison being transgender is that the whole thing came about because Capcom America didn't want girls getting beat up in a game. Sorry, but if some chick comes at me with a chain or a knife and 3 or 4 of her buds all armed with the same thing, I'm gonna kick and punch as much as i have to in order to get out of there. Also the character design is drawn straight female, there are no male features taken into consideration at all. Might as well say Chun Li is trans too.

Have you ever spent any time drawing transgender people in the nude? I can tell you that there are some things that hormone treatments do not hide.

But they're not women (not that it would stop me anyways).Their nature is still written all over their DNA (them being males),unless they were born as hermaphrodites, which are people who's genetic coding contain anomalies and they cannot be distinguished as either male or female. The real deal came when the original director of Final Fight (Yoshiki Okamoto?) came to light about Poison: she's a woman, was designed like one and Capcom Japan fucked up just to get the issue of "beating a woman" out of the way when Capcom America complained about removing the character (which they did anyway).
