  • @DD360ELITE Double jeopardy is the rule where if you get tried for something once, and they find you not guilty, they cannot try you for it again. Keep in mind, it must be the same exact crime. If they try you for second degree murder and you get away with it, admit to first degree murder, they can try you again. I have no idea what you're talking about o.O

  • hey bear in mind double jepordy dosent just protect the guilty from a overbearing justice system but also the innocent. weather you agree with virdicts or not sometimes good people get pinned for crimes they dident commit and bad people do get away... but at the end of the year you hope that the good in justice outweighs the bad.

  • Well your laws are better than in the UK, one person was given a 6 month jail sentence for simply walking through a riot area in London on his way home from work! he didnt do anything wrong, just the wrong place at the wrong time!

  • I personally believe that you should be able to retry and sentence someone again if you have new solid evidence. Because even though something like this is rare where someone owns up to the crime only after they'd been cleared doesn't necessarily mean that theres not many more guilty people walking free and not confessing thereafter.

  • @K2ACP As with all of the first ten amendments, they were put in place to insure freedoms. This "double jeopardy" clause in the fifth amendment is there because innocent people were tried, found innocent, then some other evidence that later incriminates him, then convicted in colonial times. This law protects Americans from this. It's just this happens sometimes to actually guilty individuals and it's just too bad.

  • @MarkZZcom sure, however, new evidence many times almost always makes it possible to know the truth that much better. considering jon said that this guy just told the police that he was guilty, he could've just been messing with them, knowing that they can't do anything about it. back in the colonial days, they did not have various forensic techniques that we have today. I say you can retrial if new evidence shows up however a minimum of 10 years after the first trial, without any retrials after

  • It's not uncommon for people to get away with murder. It is just uncommon for them to admit to the crime after the trial.

    The defense did their job, they established reasonable doubt.
