Agents shouldn't be working with a buyer who hasn't hired them in the first place. Having a signed Buyer's Representation agreement is the first thing a PROFESSIONAL would do. It lets the buyer know they are responsible for making sure we get paid, even if they end up writing the check. I would suggest that getting the FSBO to sign an agreement is the second thing we do, thereby relieving our client of the obligation to write a check.
