the problem in the original consititution wasn't the income tax itself, it was the uniformity of it. the reason for the amendment was to enact a graduated income tax system. a flat tax or fair tax would have satisfied the uniformity requirement originally in the constitution

Infrastructure has largely been paid for in US history by Federal and State government. The greatest economic growth of any generation of human beings (USA 1865-1914) took place with a tiny central government, much less laws and no federal income tax in fact, barely any tax at all + New York became the largest city in the world. You don;t need taxes and a mountain of laws and rules to have a functional society per se.

thank you for your service, i am a retired bubblehead and my stepdad is a retired squid also. i also have an accounting degree and i no longer work int he field but i have a good grasp of our income tax policy.
the problem in the original consititution wasn't the income tax itself, it was the uniformity of it. the reason for the amendment was to enact a graduated income tax system. a flat tax or fair tax would have satisfied the uniformity requirement originally in the constitution

"voluntary compliance " is not in the law so it has no real meaning in this debate. It's just a phrase used to denote that it is first a self assesment under Title 26, that the Government does not just simply send you a bill and says 'pay up'.

i disagree with yrou post about vountary compliance, but i agree with you that it is law. the only argument against the legality of income tax that holds any water is the 16th amendment ratification argument. the typos and stuff aren't important, but some states ratified a bill which used the term 'lay' and some ratified a bill that used the word 'levy.lay places the responsibility for paying the tax on the taxpayer, like what we have. levy puts the responsiblity on the government

Infrastructure has largely been paid for in US history by Federal and State government. The greatest economic growth of any generation of human beings (USA 1865-1914) took place with a tiny central government, much less laws and no federal income tax in fact, barely any tax at all + New York became the largest city in the world. You don;t need taxes and a mountain of laws and rules to have a functional society per se.

Lacy, 658 F.2d 396, 397 (5 th Cir. 1981) - the court, in upholding the taxpayer's conviction for willfully and knowingly failing to file a return, stated that " . . . the purpose of section 6020(b)(1) is to provide the Internal Revenue Service with a mechanism for assessing the civil liability of a taxpayer who has failed to file a return, not to excuse that taxpayer from criminal liability which results from that failure.

In discussing section 6151, the Eighth Circuit Court of Appeals stated that "when a tax return is required to be filed, the person so required 'shall' pay such taxes to the internal revenue officer with whom the return is filed at the fixed time and place. The sections of the Internal Revenue Code imposed a duty on Drefke to file tax returns and pay the . . . tax, a duty which he chose to ignore." United States v. Drefke, 707 F.2d 978, 981 (8 th Cir. 1983).

The requirement to pay taxes is not voluntary and is clearly set forth in section 1 of the Internal Revenue Code, which imposes a tax on the taxable income of individuals, estates, and trusts as determined by the tables set forth in that section.

Tedder, 787 F.2d 540, 542 (10 th Cir. 1986), the court clearly states, "although Treasury regulations establish voluntary compliance as the general method of income tax collection, Congress gave the Secretary of the Treasury the power to enforce the income tax laws through involuntary collection . . . . The IRS' efforts to obtain compliance with the tax laws are entirely proper.
