Hulk deserves to be in this because he was the first enemy the avengers fought in the very first Avengers comic. FOR ALL IDIOTS. Talks between Norton and Marvel broke down, and the role was instead offered to Mark Ruffalo, who accepted. Norton wrote a public response to the decision on his Facebook page, stating that he will not be appearing in The Avengers, but thanked Marvel Studios for considering letting him reprise the role.

Spiderman/Wolverine were licensed to Sony and Fox years ago, and cannot appear in a film made by Marvel/Disney. They werent even 'ORIGINAL" Avengers anyway.
