But their argument is that "persons" refers to ALL people within the US, not just citizens. But this is asinine! Do terrorists have all the rights of law-abiding citizens? Do tourists from abroad? The real constitutionalists are few and far between, such as Ron Paul, the LP, and the fine men and women at the von Mises Institute. I'm tired of these phony "constitutionalists" who only focus on either the bill of rights or interstate commerce clause or whatever and then IGNORE everything else because it doesn't fit their agenda. I bet you all the socially liberal ACLU lawyers who fully believe in the bill of rights are also economically liberal and believe the welfare state is ok.
In fact, the welfare state and many other agencies are grossly unconstitutional. The welfare clause in the first area of the Constitution DID NOT pertain to the actual program of welfare. Anyone who interprets it that way is just a dumbass. And, might I add, the term "people" or "persons" in the Constitution is merely a formality. It refers to CITIZENS. Illegal and legal immigrants do NOT yet have all the constitutional rights, I'm afraid. "People" does not mean ANYONE in the country.
Sometimes, I'm afraid, the ACLU takes the issue of "civil liberties" a little too far and interprets the Constitution too loosely. Look, I am prochoice, but Roe v. Wade's decision was NOT the constitutional one. It should've remained a state issue. After all, by 1973 plenty of states had legalized abortion to some extent already. It was only a matter of time before they all legalized it on their own.
The welfare state and those other unconstitutional agencies should be the purview of the states, per the 10th Amendment. But too many liberals overlook that part of the Bill of Rights, oddly enough. It's like it doesn't exist. When's the last time you heard the ACLU argue a big states rights case? Usually if they do it's only b/c the issue conforms to their preconceived liberal notions, not b/c of states rights in and of itself. They think that's some stupid "right-wing" thing.
I bet these are the same dopeheads who voted for the "Constitutionally INELIGIBLE" candidates, John McCain and Barack Obama, neither of which, were eligible to run for POTUS.
When it's YOUR rights that are affected, then you're a "Constitutional Voter"? But when it means getting your boy into office, I guess the Constitution doesn't matter, right ACLU?
