He is still alive because 1st degree murder, the only conviction that holds eligibility for the death penalty, is very specific in NY state. 1st degree murder only applies to the killing of a state official, eg. police/paroles officer, or a murder that has been committed whilst in the process of committing another crime. Berkowitz's murders didn't fit either of these criteria.
