I jailbroke my iPod for the reason I think everyone did, customization. apple tells us that it is illegal to do jailbreak with my legal optained Idevice, if I bought it from you I should be able to do what I want with it. The way I see it, if it is considered illegal, there's absolutely nothing apple can do about it. It's like downloading music without paying for it. Also illegal, but hardly anyone gets caught doing it. Let apple label whatever they want it but in the end if it is considered illegal I will continue to do it because I know I will never get caught downloading cracked apps or whatever. i answered this question here before but i will answer it again last time i said it was legal, because of the good points you made. You have went on and told everyone that you brought these expensive device and apple says you cannot customize it that is ok i think. But right now i will change my mind and say its illegal. Why you might ask, well since people do download cracked apps that should be paid for on the appstore,
1. Apple is doing a lot of this with iPhone OS 4 eg. multitasking, custom background (not themes but hey it's a start) video recording, etc.
2. Jailbreak your iDevice now! It's actually in the Constitution that if you do something that later becomes illegal, it's okay because you did it when it was legal. SO if you JB now and it becomes illegal later, you're safe.
I understand why Apple says that jail-breaking is illegal. When someone uses cracked apps they are stealing, because those apps cost money. So jail-breaking in a broader sense is technically illegal, unless you refrain from using cracked apps. I agree with most of your arguments, but I believe it would be better to be safe than sorry. Besides, you said that in your poll that the MAJORITY did use cracked apps. I don't mean to rain on you parade, but jail-breaking is really not worth, I think.

I think it should be legal unless you steal from the app store because nintendo had this same problem with illegal ROMs and it was considered pirating. But apple shouldn't make it illegal to get custom firmware, I don't think sony made it illegal but the PSP you could download themes. So they opened it up and Sony was the only company to accually have good custom things.

I don't think they can track you, unless you send them an email or something that says you did it. But I don't think anyone is THAT stupid, lol. Also, all it does now is if you ask for help with your iDevice at a retail store or something and they see that it's jailbroken they can't help you; it voids the warranty.

The way I see it, if it is considered illegal, there's absolutely nothing apple can do about it. It's like downloading music without paying for it. Also illegal, but hardly anyone gets caught doing it. Let apple label whatever they want it but in the end if it is considered illegal I will continue to do it because I know I will never get caught downloading cracked apps or whatever. They will continue to sell new iphones/ipod touches and people will still continue to jailbreak it.

It takes people, time, and money to develop and sell an app via the iphone app store ITS NOT A GOLD MINE. The developer only gets a percentage of the sales and that percentage is split into individual of that game-maker. U CANNOT SAY IT IS JUST PEOPLE BEING GREEDY

good point... if you buy the ipod you should be able to do whatever you want with it.
is hitting it with a hammer illegal? NO. So you can use cool themes and perks.

Ok we all know jailbreaking is not illegal at all BUT! if you make the software that jailbreaks your ipod/iphone and post it on the internet or etc. they will fight back and you have a major chance of being sued for alot. So your safe as long as you dont make jailbreaking software so enjoy! :D

Two things:
1. Apple is doing a lot of this with iPhone OS 4 eg. multitasking, custom background (not themes but hey it's a start) video recording, etc.
2. Jailbreak your iDevice now! It's actually in the Constitution that if you do something that later becomes illegal, it's okay because you did it when it was legal. SO if you JB now and it becomes illegal later, you're safe.

I understand why Apple says that jail-breaking is illegal. When someone uses cracked apps they are stealing, because those apps cost money. So jail-breaking in a broader sense is technically illegal, unless you refrain from using cracked apps. I agree with most of your arguments, but I believe it would be better to be safe than sorry. Besides, you said that in your poll that the MAJORITY did use cracked apps. I don't mean to rain on you parade, but jail-breaking is really not worth, I think.

I think it should be legal unless you steal from the app store because nintendo had this same problem with illegal ROMs and it was considered pirating. But apple shouldn't make it illegal to get custom firmware, I don't think sony made it illegal but the PSP you could download themes. So they opened it up and Sony was the only company to accually have good custom things.

I don't think they can track you, unless you send them an email or something that says you did it. But I don't think anyone is THAT stupid, lol. Also, all it does now is if you ask for help with your iDevice at a retail store or something and they see that it's jailbroken they can't help you; it voids the warranty.

You could go to jail. Now, they can't tell if an app is real or cracked (I think) so you'd be safe. But pirating is illegal even if it is on something (in this case jailbreaking) that isn't illegal.

i had my ipod touch jailbroke. i was so easy and got some brilliant themes! if u are stuck jailbreaking you should use blackra1n software. so easy!
