if you knew anything about the legal system you'd realize the judiciary is very complicated and quite powerful. a vote, even a direct one doesn't strip judiciary of its power to repeal lower law if it conflicts with higher law such as the state or US constitution. as to WHY that is...well that's complicated and would require actually reading a lot of shit.

I'm very curious what your opinion will be of judges who enforce the Universal rights and freedoms embodied by the Constitution if, for example, there is a 52% majority vote in the future to outlaw worship, prayer, or practice of any form of religion. The definition of marriage is applied to all citizens, regardless of race, color or any other division. Just as same-sex individuals may not call their relationship marriage, so heterosexuals may not engage in polygamous relationships and call them marriage. There has never been a fundamental right to change the definition of any word, including marriage. Prop 8 merely restored the traditional definition of marriage.
I am a registered voter! I believe in upholding the law! A2, Sec 8 of the state Constitution clearly sets forth the initiative process as a valid means of amending the Constitution. Proposition 8 was a direct response to the Supreme Courts violation of the separation of powers doctrine. By striking down a law passed via initiative process, the Court overstepped its authority & usurped the powers of the legislative branch. Judges must enforce the law. We can't allow Judges to be ABOVE the law.
The same decision by a judge can be seen by some as "judicial activism" and by others as the courts fulfilling their role in interpreting the Constitution. Thankfully we do not live in a country where mob rule carries the day.

Or maybe it's that the kids are 4 to 10 times more comfortable to be themselves than kids in a conservative family that wouldn't accept them. The intimidation tactics of the No on 8 folks (e.g. forcing people like Rich Raddom and Scott Eckern out of their jobs, vandalizing, intimidating, etc) has not gone unnoticed by Americans at large. I think the No on 8 folks have set themselves back at least 10 years, or maybe longer. The judges had no choice in the matter. They are obligated to follow the laws of the land. Prop 22 was completely illegal. The tyranny was the majority voting on the civil rights of an oppressed minority.

There is nothing in Prop 8 that would force gay marriage to be taught in public schools. In fact, I don't even remember being taught anything ABOUT marriage in public school!
And anyway, if any part of the curriculum does not correspond with a parent's beliefs (like sexual education, for example,) they are legally permitted to remove their child for that section! !!!!!

What happened to democracy? The people of California vote for traditional marriage, judge overrules them. Californians vote again by amending their constitution, judge overrules them again. Why do we give the courts more power than the voice of the people?

The definition of marriage is applied to all citizens, regardless of race, color or any other division. Just as same-sex individuals may not call their relationship marriage, so heterosexuals may not engage in polygamous relationships and call them marriage. There has never been a fundamental right to change the definition of any word, including marriage. Prop 8 merely restored the traditional definition of marriage.

I am a registered voter! I believe in upholding the law! A2, Sec 8 of the state Constitution clearly sets forth the initiative process as a valid means of amending the Constitution. Proposition 8 was a direct response to the Supreme Courts violation of the separation of powers doctrine. By striking down a law passed via initiative process, the Court overstepped its authority & usurped the powers of the legislative branch. Judges must enforce the law. We can't allow Judges to be ABOVE the law.

The same decision by a judge can be seen by some as "judicial activism" and by others as the courts fulfilling their role in interpreting the Constitution. Thankfully we do not live in a country where mob rule carries the day.

There are too many sites to list. If you sincerely want to know the truth, I suggest you do some unbiased research. Be careful because the findings are often hidden.
IE. About 20 studies used by the APA to claim gay parenting wont affect kids actually show that the kids are between 4 and 10 times more likely to develop a same-sex preference than other children. But they dont see that as a problem. Look up research by Sociologists at USC and the work of Trayce Hansen, Ph.D. for starters.

Or maybe it's that the kids are 4 to 10 times more comfortable to be themselves than kids in a conservative family that wouldn't accept them. Or it could be that it's hereditary, therefor it wouldn't be uncommon at all to find more than one gay in a family. And no they don't see it as a problem because homosexuality is not a disease. It's a love that many people fail to understand.

I don't think it will be 2012. The intimidation tactics of the No on 8 folks (e.g. forcing people like Rich Raddom and Scott Eckern out of their jobs, vandalizing, intimidating, etc) has not gone unnoticed by Americans at large. I think the No on 8 folks have set themselves back at least 10 years, or maybe longer. Maybe they will have more luck with where they have only had luck: getting a cherry-picked few judges to illegally legislate from the bench and rule by fiat with judicial tyranny.

I agree with this point. The No on 8 crowd either has a really bad PR team, or are out to sabotage themselves for no reason. Equal rights are in play here, as the law applies to everyone equally however it does not favor the preference of homosexuals.

The judges had no choice in the matter. They are obligated to follow the laws of the land. Prop 22 was completely illegal. The tyranny was the majority voting on the civil rights of an oppressed minority.

Everyone is either a man or a woman. Marriage is available to all, if they choose. And if they aren't interested in man/woman relationships, that is their right too. They can live their lives, choose their partners, and even have all the same civil benefits with domestic partnerships. Prop 8 appears to have passed. Now tolerance goes both ways in California. I appreciate all of you who voted and participated in democracy on this most important issue. I appreciate the kind and respectful tone and good people that are on either side of this issue. I'm glad when we can be tolerant of each other. And I'm thankful for freedom of speech, a fundamental human right.

As in the case of Loving v. Virginia, where it took judges to end laws against inter-racial marriage, it took judges to stand up and say that not allowing gay marriage is unqequal treatment under the law and wrong!
The judicial system is there to protect the minority against the tyranny of the majority.

Judges have nothing to do with this, no matter what one or two idiotic politicians may have said to piss you people off. The fact is that we can either decide to put a single sentence into the constitution or not, and not a word in that sentence says anything about education, heterosexual marriages or the judicial system.

There is nothing in Prop 8 that would force gay marriage to be taught in public schools. In fact, I don't even remember being taught anything ABOUT marriage in public school!
And anyway, if any part of the curriculum does not correspond with a parent's beliefs (like sexual education, for example,) they are legally permitted to remove their child for that section! !!!!!
You should know this. Don't spew your inaccurate justifications for this.
