Did you know you posted SpongeBob stuff on your video? Viacom will will remove this video when they find it, even if you got permission, they will remove it, that is how Viacom rolls. Viacom has been flagging videos, whether or not it has copyright content belonging to them, or posted on Youtube accounts that Viacom or their partners own, and these videos are included in the lawsuit, Viacom is suing Youtube for videos Viacom post, not just videos regular people post. I hope Viacom lose this case

This case has little to do with the Napster case. Google is doing its best to keep copyrighted content off their pages. Furthermore, this is more of a privacy issue for users than anything else at this point. And of course, there is the fact that Napster didn't carry even a tenth of the clout that Google does...

Viacom shot themselves in the foot throwing a hissy fit over youtube clips. Small South Park, Spongebob, clips on youtube is good free advertising. Example, most parents never watch South Park, send them funny youtube clips, they see what you enjoy, go out and buy South Park stuff on birthdays ect. If clips are banned, far less people will enjoy Comedy Central material, buy fewing stuff, profits are lost! Regulate the material makes more sense. YouTube doesn't know which videos have Viacom content with in it. It would be unrealistic for Viacom to expect Google to be able to search and identify that amount of content.

Whether you watched Viacom stuff or not, they will have ALL Youtube users' IP addresses. Then they will check ALL the stuff that you have watched on Youtube. And they will see if you have watched copyrighted material. And, based on what I have learned about Viacom in the past, they may penalize you for having watched copyrighted material, even if it's not from Viacom.
