Our founding fathers stated clearly that citizens have the write to a speedy trial. Previously kings had jailed people for years because killing them would cause an uprising. Our fathers knew that a charge must be tested in court. This was a safety net for citizens that disagreed with the leaders.

This right was not written to apply to enemy prisoners of war. That is covered by the geneva convention. Only left leaning lawyers would extend here to expose our intel gathering methods.

Article 1, Section 9, Clause 2 - "The Privilege of Habeas Corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it."

Article 10 - "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

The Unitied States government was not granted the power to suspend the Great Writ by the Constituion and has no such power.
