Facts : Both men killed by Mr. Horn, had already once been deported by police for being illegal aliens whom were smuggling in cocaine into America. So they had been deported once and came back a second time and were responsible for a recent string of burglaries. Yes it is. As a black man in texas with a concealed handgun permit I can tell you that in such an event that the use of deadly force is justifiable, you are bound shoot a warning shot. There is also no law to my knowledge as to where you can shoot someone; ie if you are justified in using force, then it makes no difference where you shoot someone.

I understand that they may have a sad personal story, but that doesn't excuse their actions. Suppose they are taking what little someone has left? What happens to the next house they break into? What if someone is at home? The cops usually can't help you in these situations since they can't be everywhere.

I am from Alabama where this would have been legal under the Castle Doctrine. Running away or not is immaterial under the law as it is now. Retreating/running away (possibly to establish a stronger defensive position) is not a viable legal defense.

A law was recently passed in Texas that allows people to use deadly force to protect property. Horn will be the first to test this law. The outcome will be interesting. The main thing will be to see if the law can be applied to other people's property, too.

Whether he was right or wrong is for the courts to decide, either way, this will be a good case to test it on, the two thieves were drug dealing illegal aliens, with criminal pasts. They won't be missed.

Do you have confirmation that an out of uniform officer was on the scene before the shooting. All reports state the earliest an officer arrived was 6 seconds after and that was from activists which can be exhagerated. They were on his property at the time they were shot after breakin into his neighbors house. One died on the spot the second died running down the street

You tube seems to hate links in comments however chron com (Houston Chronicle) has an article titled "Pasadena police say Horn shot 2 men in the back" with a full account of events including the 911 call the events that transpired from both Horn and the officer. plus the autopsy report. It's a good read as it clears alot of the grey area of murder or not. And explains why he wasn't immediately taken into custody.
