The difference is that Madonna collaborated with Martin Solveig on her upcoming album so it is a contractual relationship. Madonna did not have a contractual relationship to collaborate with Gaga on "Born This Way". So it's really up to her, the listeners and fans to decide whether "Born This Way" was inspired by "Express Yourself" or simply a rip off. Please note Madonna's previously pointed out that "Born This Way" is a redone of "Express Yourself".
