  • Always remember there is no expectation of privacy when you are in a public place; that goes for cops (I was one until I retired after nearly 25 years) and citizens. I nearly always recorded traffic stops because who wants to be accused of doing something wrong? I don't understand why any hearing was without recording devices or stenographer when that guy went to court and understand why he was paranoid and 75 years would be absolutely a travesty.

    Police already violate/ignore laws already, as long as it suites their purpose. If I record a cop beating someone who isn't resisting, a innocent bystander or what have you; they are going to deny it in court under oath if it suites their purpose or the purpose of the state.

  • Spurious argument: the right to film police action is not synonymous with the right to film private citizenship behavior. Hence, how can there be a link between corrupt politicians and the right to film police? You should refrain from acting as an expert, soap-boxing every issue you read about - your videos are best when they have an underlying theme of economics which ensures they have substance.     The worst aspect with extensive jail time is that most prisoners are poor and the whole prison system is funded by the poor and the middle class. Listening to Gingrich and Co., you can guess the prosecuting side is the "hard-working [rich] Americans".

Suffering harrassment from a deranged neighbor when I lived in Maryland, I brought the tapes I'd made of the foulness that had been screamed at me and my kids on a public street and was told that I could not produce them or I would be subject to prosecution and imprisonment.

    Of course, no such prohibition exists on government in Maryland.

To my thinking, once you provide public notice, you're within your rights to continue videotaping. If the neighbor persisted in his deranged behavior, it would've been his own fault the event(s) would've been caught on film, whereas someone with common sense would've ceased the behavior. Yes?

  • @TheMercilessEye Ironically, I could have filmed her as much as I liked, but I couldn't audio record unless I had her consent either on the recording itself or in writing. Sadly, this was several years ago and the video recorder I had was a bulky VHS model that I couldn't really carry to and from the car every day.

    The neighbor persisted (and likely would have anyway) to the point that she was found guilty on three occassions (but the best evidence never saw the light of day).

  • There's always been a tacit agreement of duplicity between society and police officers. The nature of the law is... absurd, one can't possibly even know all the laws. In Wyoming you could be fined $750 for not closing a fence. Police officers are mostly hunting for people doing things which they consider unethical. The problem is that if you record anyone for 10 minutes, they're sure to break some law if you look hard enough, that includes the police.

    I can see why that would cause problems.

Now, all people are or should be considered innocent until proven guilty and therefore one may wish to consider publishing a tape before publishing said tape. I real concern is the tape from the start of the activity or just a film clip of the last moments of the activity. Clearly these need to be addressed in a court of law.

  • Such laws are totally anathema to a truly F R E E society. They exist only because police want to be free of scrutiny. Pretty scary, considering the powers they have. If they were an essentially honest bunch, they would WELCOME public scrutiny such as this to weed out the bad apples among them.

    A video camera may be the only weapon a citizen has for self protection in instances of police corruption/brutality. All such laws must be stricken from the books.

  • Anything and everything that can aid in a citizen's legal defense should be allowed. IMO police don't have the same rights as regular citizens because they are the long flabby (Simpsons) arm of the law. They already get to search your property, carry guns basically everywhere, use deadly force, et cetera; if someone wants to make sure they are doing so justifiably and responsibly by video/audio recording them, he should not be denied this.

  • Thanks a lot for this video. I have 2 regrets about this topic. For one, this is MONUMENTAL corruption, literally, in the symbolic sense; if there is any question about whether our political system is corrupt or has ever been corrupt you can point to the fact of this case. It is self-evident that these consequences are grossly if not inversely disproportionate to the burden this action places on on society, in fact, this type of law enforcement IS the burden on society.

  • I saw this story a few months back and I'm still disgusted about it. Our first Amendment rights are being thrown out the window these days. Here's the thing. If you record a cops doing something GOOD such as rescuing a baby or playing with their K-9 Unit dogs they don't care about being a camera. The second you record them doing something wrong, they want you behind bars. It's not just politicians. It's the police force themselves.

    For example, if I record the police, and catch them doing something illegal (planting drugs, wrongful searches etc.) am I allowed to use that as evidence, or does it fall under the laws that state if evidence is obtained illegally that it's inadmissible? or does that only apply to cops who obtain evidence illegally?

  • My family is going through the court systems in Illinois right now. It is one of the most bloated, inexcusable pieces of crap bodies of legality I've ever seen. Living here in IL. is alright, except for the politics and legal system. They're one of the worst in the country.

  • Eavesdropping is secretly listening to private conversations (without their consent).

    Wiretapping is eavesdropping so and so is hacking into someone's computer. Openly video-taping the activities of police, government officials and even private citizens is not eavesdropping and everyone knows it. It would be hard to argue that simply taping the police's public actions would constitutent eavesdropping.
