Either Judge Junell actually put his pen to paper on this ruling, or else there exists a computer that forged it there. There is simply no other way for the Odessa American to have a signed copy in their possession.
The recordings can help impeach kops that decide to not tell the truth. In Federal court then it is an advantage to the kops, because they can "compose" their on version of a suspects "confession". "Confessions" do not have to be recorded as they do by Texas state law. Then it is kops word agaisnt the defendant.
The altered documents by Travland that was withheld from the defence in this case were so important. It can be used to impeach the kops "compositions".
Maddens brief has been filed on her motion to vacate. Even though limited to just a few narrow issues I think it is very strong. Her attorneys did not put in what I think is one of the most glaring problems the citizens of Odessa face. The fact that the US Attorney in Midland did not want the police officers in Odessa to make any type of record of their "interviews" with suspects. We have an internal OPD document that shows US Attorney "conspiring" with OPD to deny fifth amendment rights.
Junell gave the defense until Dec. 4 to present a brief on the issue and said the prosecution would have a week to respond. He planned to rule on the issue by Dec. 18.
The issue is not whether Ms. Madden is guilty or not guilty, Junell told Sampson. The sole issue today is whether the government should have produced that document.

Also directly from the judgement :"Madden contends that HER ADMISSION TO POLICE THAT THERE WAS METHAMPHETAMINE IN HER VEHICLE should not have been admitted because it was either the fruit of an illegal stop or obtained in violation of Miranda". If she is saying that HER ADMISSION should not be admitted, that would mean that she did in fact admit to having the Methamphetamine. Kind of hard to say you didn't know about the drugs, if you admit they are there.
The video of the traffic stop included in this film proves she did not admit to having meth in the car. All reporting officers claim upon exiting the auto, Yolanda began yelling "The meth is in the car, don't let my daughter see it." You can clearly see in this vid she said no such thing upon exiting. Nor did she afterward. I have the entire tape and am not lying.

if you just don't carry drugs with you, you'll probably be okay. Also I would avoid having telephone conversations with drug dealers. Additionally I would not meet with drug dealers in parking lots. If you do these three things, I think you will be okay.

this kind of thing is goin to continue as long as there is gun control, that prevents good citizens from having guns. we are the only country that has such insane crimes, because we won't allow our good citizens to carry guns for protection. so we need wAY TO MANY COPS and we cannot have the luxury to find quality police officers.

Then Detective Preston Peavy set out over the next four years to manufacture my guilt with the help of other corrupt officers in Cherokee County!! A cloud of confusion settled over the Yolanda Jean Madden case this weekend as attorneys scratched their heads over whether a judgment was signed Friday by U.S. District Judge Rob Junell.
Either Judge Junell actually put his pen to paper on this ruling, or else there exists a computer that forged it there. There is simply no other way for the Odessa American to have a signed copy in their possession.

The recordings can help impeach kops that decide to not tell the truth. In Federal court then it is an advantage to the kops, because they can "compose" their on version of a suspects "confession". "Confessions" do not have to be recorded as they do by Texas state law. Then it is kops word agaisnt the defendant.
The altered documents by Travland that was withheld from the defence in this case were so important. It can be used to impeach the kops "compositions".

Maddens brief has been filed on her motion to vacate. Even though limited to just a few narrow issues I think it is very strong. Her attorneys did not put in what I think is one of the most glaring problems the citizens of Odessa face. The fact that the US Attorney in Midland did not want the police officers in Odessa to make any type of record of their "interviews" with suspects. We have an internal OPD document that shows US Attorney "conspiring" with OPD to deny fifth amendment rights.

Junell gave the defense until Dec. 4 to present a brief on the issue and said the prosecution would have a week to respond. He planned to rule on the issue by Dec. 18.
The issue is not whether Ms. Madden is guilty or not guilty, Junell told Sampson. The sole issue today is whether the government should have produced that document.

Having been locked up in Midland County on a felony charge for petty theft and resisting arrest i can attest first hand that the judges, DA and police get away with violiating civil rights often. They are above the law and the county jail extorts innmates thru the monopoly of family ties from the sherrif to the pre-trail all the way down to the commisary. While our (Canadian) law may be somewhat more 'relaxed' on the subject, the corruption still exists and the number of innocent victims continues to rise. Isn't it amazing that the court system puts all the info they want on line - except the actual transcript. You know that info that might really reveal some truth. This was bench trial. All are going to be amazed at transcript vs Junells rulings. totally WACKO!

It was not codefendant (you really are system)it was CI. Read his testimony and check his polygraph. Oh yeah you just care about what court wrote! well it will be proven that the courts "findings of fact" were far from factual!The trial transcript and Junells ruling just don't track.junell has stonewalled but is now off case. His findings only say kops version and he even failed in that. He left out any defense testimony. Read transcript read his findings and tell me is he stupid or corrupt?

I've been asking people to post the two things you told me to check out since I first read about this on the web. Apparently you have or have seen the whole video from the traffic stop, and have or have read the entire trial transcripts. I have not, don't have them, can't find them. If you or someone else would post them that would be great. If you were to do that, perhaps I would be a little more convinced that the things you say happened actually happened, until then i'll believe the judge

I am not related to the judge. I've never seen one Judge's "lair", let alone 90% of these secret hideouts that you describe. Look, I just want to see all the evidence, not just edited segments. The enitre documents and video is out there, Barry claims to have them. Tell him you want him to post them in their entirety.

Agin teh video shows cops lied when they made that statement. Yolanda hard terrible Lawyers. They "stipulated "evidence even knowing it was planted. Lawyers argue law and do not try the case. The prosecutor told the defense lawyers judge really would be up set if they didn't stipulate. Talk about bd council. If you really want to see truth look at trial transcript. All you see from court is judges rulings. You are chasing red herrings and Junell will loooove you!

Also directly from the judgement :"Madden contends that HER ADMISSION TO POLICE THAT THERE WAS METHAMPHETAMINE IN HER VEHICLE should not have been admitted because it was either the fruit of an illegal stop or obtained in violation of Miranda". If she is saying that HER ADMISSION should not be admitted, that would mean that she did in fact admit to having the Methamphetamine. Kind of hard to say you didn't know about the drugs, if you admit they are there.

The video of the traffic stop included in this film proves she did not admit to having meth in the car. All reporting officers claim upon exiting the auto, Yolanda began yelling "The meth is in the car, don't let my daughter see it." You can clearly see in this vid she said no such thing upon exiting. Nor did she afterward. I have the entire tape and am not lying.

The only authority I worship is my Lord and Savior, Jesus Christ. If you have the entire tape, please post it. I want to make up my own mind by viewing all the evidence. I am sorry if you fault me for taking the Judge's word over yours, it's just that the Judge's agenda is "justice" and yours if money (selling your DVDs and gaining advertisement for them). If you have the whole tape, and it shows that all these people lied, post the whole thing, and you will win alot more to your side.

And you assume my motives are only for money. One of my motives is money...this is how I make a living...protecting the American people...sort of like a lawyer only I do it differently. I have other motives as well...I hate our current police system...it's unconstitutional and unfair. I hate bullies. I hate lying judges. I hate that we have over 1 million non-violent citizens in jail. Those are a few of my top motives.

Judges' salaries are not dependent on the # of guilty verdicts rendered. I dont think any judge would want a reputation for wrong and unjust rulings. That would draw too much heat and lead to their removal. What is more prominent than a judge that runs a tight ship and has a reputation for throwing out bad cases? Cops dont get paid per arrest either. I dont distrust you because youre making money I question your version because you havent posted your evidence in its entirety. Thats my logic.

From the official 5th Circuit Court of Appeals: "The informant identified Madden by name and photograph, and provided credible and detailed information about her, including her history of selling methamphetamine to him, where she lived, her father's place of business, and what vehicles she drove. As police observed, the informant initiated 2 telephone conversations with Madded to arrange to buy methamphetamine from her." She knew him and to her this was just another day selling meth.

In Summer 2005, my friends and I were issued citations in another small Texas town--Uvalde--for "possession of alcohol under the age of 21", but I didn't have anything.
The game warden proceeded (despite my friends' defending me) and said "if it's within an arm's reach"...and it wasn't. I ended up getting an attorney, and I was told "they said they have evidence that you had alcohol--if they're lying now about having evidence, they'll lie in court" and was advised to accept the plea bargain.

if you just don't carry drugs with you, you'll probably be okay. Also I would avoid having telephone conversations with drug dealers. Additionally I would not meet with drug dealers in parking lots. If you do these three things, I think you will be okay.

I don't have a need for marijuana yet, I've never had the need for it's use. I feel real bad for Yolanda and her family's situation. I'll watch more of Barry's NeverGetBusted youtube vids. KopBusters looks like it will change alot of honest peoples views for the positive towards decriminalization of marijuana and for the negative with how the legal system treats it's citizens.

The cooperating defendant identified her in a photo lineup. how do you think he did that? I would venture to say because he knew her from the drug business. If you truly believe that the police target people at random and plant drugs on them, go to the medicine cabinet and take your crazy pills. You've been listening to too much Alex Jones. If the country is so bad, please leave it so that the rest of us normal people can live in peace, away from your fantasy-filled conspiracy theories.

I have watched the video. I have read the newspaper articles. I have read the ruling from the appellate court. What have you done besides watch a video created and posted by someone with an agenda? And if you can't tell, the agenda is leading you to believe that the police and govt are evil, so you buy their product making them money. Do your own research. Don't be fooled. Don't fall into the trap.

It wasn't DA OPD had deal with Feds. The Federal Prosecutors is Glen R. Jackson.He is a resume builder.Judge Junell is guvmnt judge 99.9%. Thats how you move up in Fed system. Fed Pros. had deal with OPD narc. not to record confessions. Just have 2 cops testify a person confessed and they will be found guilty in junells courtroom. Cops say Yolanda confessed to crime that is lie Cops composed the "confession". Have proof cop lied but after trial 2 late did not expect blatent perjury

Yolanda is just another casualty of the war on drugs. I would bet her dad was all gung-ho for law enforcement and the war before he had his eyes opened. Tell me, is the winning this war worth the cost? I wish juries would just start saying "no." They have that power. If they weren't so damn ignorant, the system might work like it is supposed to.
