many of these companies have their OWN channels here on you tube. They can play it,,,let some one download it....not buy dvd....but if YOU DO IT......no good!
The great YouTube copyright debate is laughable. It usually means films and other videos are illegally shared and profited from by the great YouTube Company. This should stop.
@TomAwesome39 One of my videos was recently deleted due to a copyright claim, even though I gave full credit in the description to the musician. It wouldn't have really shocked me, but it's a very underground record company that filed the claim. Record companies are becoming obsolete anyways, but how would having an underground song on youtube make them lose more money than gain? Underground is underground because it needs more publicity to make profit, which is exactly what it was getting.
@TomAwesome39 The way I see it, record companies probably try as hard as they can to remove songs posted on the internet because music distribution's evolution poses a huge threat to their profits. The easier it is to obtain or hear music via the internet, the more money they lose after all. Anyways, it's really disappointing how even some underground record labels are cold when their musicians are often closely connected to fans.
I think it's kinda stupid for some companies to get upset.. I won't name names, but many "entertainers" use other people's stuff all the time. They are making money off it, but they have lawyers. If I like a certain movie or tv show I can't promote what I like about it FOR FREE.. It's cool I will just boycott buying anything from anyone that has a problem with me promoting their stuff.
I don't get this, Why is this a big deal?IF this is such a big deal, then why not just shut down youtube? Most of the people's vids on here are ''music'' video or a song with lyrics on the screen. Most of the ones I have seen always cite the song, and artist in a link to Amazon or iTunes. I just don't get it.

copyright sucks. in the uk we call it big brother is watching. we put videos on here for people to enjoy not for financial gain. you tube gains financialy by advertising on your video. did they get my permission to advertise on my videos no they did not.

In law copyright infringement does not refer to actual theft, but an instance where a person exercises one of the exclusive rights of the copyright holder without authorization. Courts have distinguished between copyright infringement and theft. Court cases show interference with copyright does not constitute stolen property.
Explain to me why one of my videos featuring two guys playing and singing the Haleluja song got flagged as infringing copyright? the guitarist played it through improv and the guy singing sounded nothing like the original.....thats as ludicrous as saying humming or whilsting a song is also infringing.

I purchesed Music and video on what is now obsolete media formats for decades. Over time some of these formats became obsolete, or degraded. The content I doenload is the same as I purchsed in the 1970's. But now I have this same content in a modern transportable form.
You know...If you think about an artist taking time to write, sing and produce a song which may cost him/her considerable time and money then someone comes along and steals it for their video, it's not fair, is it? Most video producing software now has 'royalty free' music for you to put on your video, if not do a google search and get some, there's lots out there for free with no restrictions. Don't steal other's music to sell your video! The video isn't good if you need pop music to sell it!
What about covers of songs? I mean, I know I have the song playing in the background so that I don't do something like screw up, but my voice is still louder. In fact, most of the times that's all you hear. So, are covers wrong? Also, what if WMG doesn't own the material they copyrighted. I checked to make sure on several accounts. The bands that I do my covers on are not signed on to WMG and they're the only ones who claim copyright. The actual record labels don't say anything.

Bottom line is the law makes and remakes its definitions for what is theft. If one day it deems that you not paying a toll to use the internet is theft then it will be so. It disproportionately invests time and energy into enforcing copyright law. Hmmm I think there are political interests here that matter more than the progression of society. What if you are using a video that is completely yours, such as a home video, and decide to use a short segment of a song or songs. Would that still be copyright infringement?
@cellphonemania4u Probably can be taken down if somebody flags you in, but it goes under fair use if you only use little bits. You you can file a counter claim.
If certain videos are being blocked because of copyright in my country and others I'd call it discrimination. Its just stupidity that YouTube (Now Google) are to block videos and close them because of copyright and the fact they are including some songs. I know they make money out of it and they don't wanna get sued... but honestly... I think Google deserves to be sued.
I like watching 80's music videos. The is best way I can see them is through youtube. I was to young to remember the 80's but know I can see them.
These videos make me want to buy cd's from bands like "The Outfielders", "Tears for Fears" "men at work", if I can find them.
My point is the internet controls the modern world of music. As long people don't sell the content there uploading the laws of copyright should be envalid.

I lost 49 videos on my last account, because they closed it with absolutely no warning what-so-ever because of a similar reason, for using a clip from a show that was not even aired for years upon years (repeated it several times into a little remix).
My video got deleted for having 4 MINUTES OF MARIO KART MUSIC in the background. -_- What do I do? I sent a DMCA counter-notification and answered the questions correctly. Do I just wait for 10 days and hope Youtube decides to put my video back up? Or are they just gonna pretend nothing happened? I WANT MY VIDEO BACK

Does putting original versions of cover songs (songs from different artists, or composers) cause some kind of infringement on YouTube? There are songs that I interpreted which are songs from the 1960s, and they have been matched as "third party content". The content owner is CS! What is CS? What does it stand for? I have not gotten any "third-party conent" warning from WMG, but I did from CS!

The people who write, compose, perform, engineer, and produce most of the music you hear today work hard at their craft and deserve to paid for their labor. I'm saying that people deserve the right to choose not to pay for culture. Just as they do now, but as it s now the only option if you don't want to pay is breaking the law. People fileshare and download music just as much anyways, so why not make it legal? I lost three channels because of cover songs by local bands. I got three strikes in two years out of a thousand uploads total. I lost a wormfarming channel with no violations because it was tied to the same e-mail and I had access to my Gmail account suspended as well. I'm through with YouTube, good riddance. Make sure every channel is tied to a different e-mail account, that's where I screwed up big.
Copyright is NOT property: For all the talk about "Intellectual Property", Copyright is not property at all. It is enshrined as a "limited and exclusive right" to profit from their creations. The slogan "Loaned, not owned" comes to mind. Copyright is NOT control: Having copyright to something does not give you control over where it is shown, who watches it or what they can do with little bits of it. Unfortunately, companies like Viacom like to yell "PIRACY!" anything they can't control!
Here's the problem Kenrg, the older media companies are incapable of adapting quickly to technological change. Whatever ideas they may have about making their material available on the internet will be disappointing. They won't develop a business model that meets the needs of the audience.

Under current law, as stated in this vdeo, using a song as background in a tube vid is same as shoplifting at local Wal mart.

I'm only interested in copyright laws because I have a series in the works and I don't want some scumbag stealing it and claiming it as their own. However I think getting permission to use a song in your favorite video is a daunting and tiresome not to mention expensive endeavor. No wonder people do it without permission.

YT/Google will never enforce copyright across board on YT. They know it would KILL the service. YT would shrivel up and die. They have no choice, because they are covering their asses. Rob27188314: I see. So now that the internet makes it easy to copy stuff, then things owned by other people and/or companies should now be free for everybody. We should all be able to "share" the works of others that don't belong to us. If you were an author or musician who created something and wanted to make money at it, only to find you can't sell much at all because other people are "sharing" your creation on the web, I think you'd feel somewhat like they stole from you.
If YouTube truely enforced copyright across the board and did so since day one, YouTube would not be the size it is today. Also, the majority of music on YouTube would not exist. It is selective enforcement and totally disregards fair use!

If you overprice your records (like for example Zetima selling Morning Musume DVD's at 50 EUR each), people won't buy the things because they can't afford them, even if piracy didn't exist. Then add the fact not everything is available everywhere, eg. I can't get J-Pop in stores here, and buying online is difficult due to high customs, so what legal option I have in then in that case? If somebody prices something too high, that simply means you don't buy it. My point however is that you do not have the right to own the work of others with paying for it. The fact the the owners still bathe in millions proves that. And again, without piracy, I'd be limited to the music and movies sold here. Which means I'd be limited to European and American music. Thanks to piracy, I can listen to J-Pop, African music, and more.
@Elhardt And yes it is justifiable, given how much money RIAA and MPAA have made by plagiarizing other people's work for one. And the artists/actors/directors/etc. get little of the money, it's the agents/producers/etc., basically the bureaucrats behind the industry, that get most of it. So I'd rather pirate a CD then go support the artist by giving them the money at a concert, than pay for a CD only for most money to go to the bureaucrats, sorry.

It gives copyright to the recording labels rather than to the artists, so in this way, it makes the artists no more than simple employees of the labels. Who get the smaller share of the profits. Same for movies and software. The people who do the most real work get the least of the profits. Those high up who sit, threaten and sue, get the most. Piracy will be over when the current copyright/publishing system is replaced.
@Elhardt Have artists publish their songs directly online with no production costs involved and no middle man getting most of the profits, AND add ways to pay for that without a credit card or an American service such as PayPal, and you'll see how prices WILL go down, globally, since people around the world will be buying the stuff this way.

Before internet piracy, people would record songs off the radio. So still most people never bought jack shit. And made tape recordings of CD's. Yet lack of profits due to that was fine. No-one was sued. But when the technology changed to the Internet, it suddenly became a problem? Why?
The onus lies on the publishers' shoulders to arract people to buy the stuff. First, implement laws that make sure everything is available anywhere in the world, regardless of how many people actually demand it. Make demand from offers, not the other way around. Second, implement online selling accepting payment methods people anywhere in the world can use and where all the money goes to the artists. And third, sell by prices people anywhere can afford. Then profit will rise again.
In short, if the publishers want the world to adapt to them, then they have to adapt to the world as well. The world must work so it's good for both sides, not so one side is legally protected and allowed to act like despots while the other side's basic human rights are curbed to ensure the first side's legal protection. And when the industry can discriminate, selling one artist in one country but not in another, that's even worse. Piracy is a way for people to rebel against the industry.

No profits involved, this was for fun/family/friends. I don't have the gift of writing music, and I've learned to play cover tunes by ear since I started playing...So... I guess unless I write & perform my own material, I can't be viewed on Youtube playing my instrument...?? does this sound right?

there IS a fair copyright use law that allows use of copyrighted material for use in a video, etc. Still, permission is better because there is too much of a gray line on that matter. I choose not to post anything copyrighted stuff because it isn't worth all my time making a video just to have it deleted. I am also creative and resourceful enough to do my own stuff. If you have NO brain for creating original stuff then why be on youtube?
Is uploading copyrighted material wrong or is download copyrighted material wrong? Cause the way interpretted is that if u upload copyrighted material and try to make a profit off of it its is a crime or something. Or if you dowloaded a cd for free and then sold it. But is downloading material copyright infringment when you don't sell it? Because it sounds to me that u commit the crime when u profit from it.

It wouldn't have really shocked me, but it's a very underground record company that filed the claim. Record companies are becoming obsolete anyways, but how would having an underground song on youtube make them lose more money than gain? Underground is underground because it needs more publicity to make profit, which is exactly what it was getting.

@TomAwesome39 The way I see it, record companies probably try as hard as they can to remove songs posted on the internet because music distribution's evolution poses a huge threat to their profits. The easier it is to obtain or hear music via the internet, the more money they lose after all. Anyways, it's really disappointing how even some underground record labels are cold when their musicians are often closely connected to fans.

I think it's kinda stupid for some companies to get upset.. I won't name names, but many "entertainers" use other people's stuff all the time. They are making money off it, but they have lawyers. If I like a certain movie or tv show I can't promote what I like about it FOR FREE.. It's cool I will just boycott buying anything from anyone that has a problem with me promoting their stuff.

You are lying to people when you say copyright infringement is theft. In law copyright infringement does not refer to actual theft, but an instance where a person exercises one of the exclusive rights of the copyright holder without authorization. Courts have distinguished between copyright infringement and theft. Court cases show interference with copyright does not constitute stolen property.

You know...If you think about an artist taking time to write, sing and produce a song which may cost him/her considerable time and money then someone comes along and steals it for their video, it's not fair, is it? Most video producing software now has 'royalty free' music for you to put on your video, if not do a google search and get some, there's lots out there for free with no restrictions. Don't steal other's music to sell your video! The video isn't good if you need pop music to sell it!

What about covers of songs? I mean, I know I have the song playing in the background so that I don't do something like screw up, but my voice is still louder. In fact, most of the times that's all you hear. So, are covers wrong? Also, what if WMG doesn't own the material they copyrighted. I checked to make sure on several accounts. The bands that I do my covers on are not signed on to WMG and they're the only ones who claim copyright. The actual record labels don't say anything.

Bottom line is the law makes and remakes its definitions for what is theft. If one day it deems that you not paying a toll to use the internet is theft then it will be so. It disproportionately invests time and energy into enforcing copyright law. Hmmm I think there are political interests here that matter more than the progression of society. I like watching 80's music videos. The is best way I can see them is through youtube. I was to young to remember the 80's but know I can see them.
These videos make me want to buy cd's from bands like "The Outfielders", "Tears for Fears" "men at work", if I can find them.
My point is the internet controls the modern world of music. As long people don't sell the content there uploading the laws of copyright should be envalid.

There are songs that I interpreted which are songs from the 1960s, and they have been matched as "third party content". The content owner is CS! What is CS? What does it stand for? I lost three channels because of cover songs by local bands. I got three strikes in two years out of a thousand uploads total. I lost a wormfarming channel with no violations because it was tied to the same e-mail and I had access to my Gmail account suspended as well. I'm through with YouTube, good riddance. Make sure every channel is tied to a different e-mail account, that's where I screwed up big.

Copyright is NOT property: For all the talk about "Intellectual Property", Copyright is not property at all. It is enshrined as a "limited and exclusive right" to profit from their creations. The slogan "Loaned, not owned" comes to mind. A lot of movies have been taken away which cannot be used to gain much money.
The only reason I can think of is that this kind of censorship can be used to make people "forget", "erase the past", making them subject to "brainwashing" and "obscure manipulation".

Fair use says any song or clip used in a parody, review, statement, among other things, is legal parodies are legal because aslong as it is being used to to poke fun at or to joke about itself or something else its legal, if you use a clip or song and then you talk about what you think of it then it is legal because you are stating your freedom. So if parodying is a violation, how about my case where I would like to use gameplay footage or game trailers, just for the visual aspect and then record my voice over it to explain the game or to talk about the gaming industry. I feel like that's not covered by fair use law. Would I be right?

YT/Google will never enforce copyright across board on YT. They know it would KILL the service. YT would shrivel up and die. They have no choice, because they are covering their asses. But they are also HYPOCRITS. Because they won't enforce copyright unless they have to! There is plenty of full songs on here that are copyrighted. But the copyright owner isn't complaining, so YT does nothing. COME ON YT, TAKE THEM ALL DOWN and watch YT disappear into the dust! Great investment huh google?

Rob27188314: I see. So now that the internet makes it easy to copy stuff, then things owned by other people and/or companies should now be free for everybody. We should all be able to "share" the works of others that don't belong to us. If you were an author or musician who created something and wanted to make money at it, only to find you can't sell much at all because other people are "sharing" your creation on the web, I think you'd feel somewhat like they stole from you.

@Elhardt I know I wouldn't. Profit is a privilege, not a right. You don't demand sales, you earn them. If you overprice your records (like for example Zetima selling Morning Musume DVD's at 50 EUR each), people won't buy the things because they can't afford them, even if piracy didn't exist. Then add the fact not everything is available everywhere, eg. I can't get J-Pop in stores here, and buying online is difficult due to high customs, so what legal option I have in then in that case? None.

If somebody prices something too high, that simply means you don't buy it. My point however is that you do not have the right to own the work of others with paying for it. Seems people these days think what's yours is mine. I don't care if you pirate, especially if you can't buy it here, but just don't act like it justifiable.

@Elhardt Yes but the pirates do not claim ownership of the material. And they are not infringing on the owners' right to sell since the material stays with the owners. And there are still sales. The fact the the owners still bathe in millions proves that. And again, without piracy, I'd be limited to the music and movies sold here. Which means I'd be limited to European and American music. Thanks to piracy, I can listen to J-Pop, African music, and more.

@Elhardt And yes it is justifiable, given how much money RIAA and MPAA have made by plagiarizing other people's work for one. And the artists/actors/directors/etc. get little of the money, it's the agents/producers/etc., basically the bureaucrats behind the industry, that get most of it. So I'd rather pirate a CD then go support the artist by giving them the money at a concert, than pay for a CD only for most money to go to the bureaucrats, sorry.

@Elhardt The copyright system does it all wrong. It gives copyright to the recording labels rather than to the artists, so in this way, it makes the artists no more than simple employees of the labels. Who get the smaller share of the profits. Same for movies and software. The people who do the most real work get the least of the profits. Those high up who sit, threaten and sue, get the most. Piracy will be over when the current copyright/publishing system is replaced.

@Elhardt Have artists publish their songs directly online with no production costs involved and no middle man getting most of the profits, AND add ways to pay for that without a credit card or an American service such as PayPal, and you'll see how prices WILL go down, globally, since people around the world will be buying the stuff this way.

Before internet piracy, people would record songs off the radio. So still most people never bought jack shit. And made tape recordings of CD's. Yet lack of profits due to that was fine. The onus lies on the publishers' shoulders to arract people to buy the stuff. First, implement laws that make sure everything is available anywhere in the world, regardless of how many people actually demand it. Make demand from offers, not the other way around. Second, implement online selling accepting payment methods people anywhere in the world can use and where all the money goes to the artists. And third, sell by prices people anywhere can afford. Then profit will rise again.

In short, if the publishers want the world to adapt to them, then they have to adapt to the world as well. The world must work so it's good for both sides, not so one side is legally protected and allowed to act like despots while the other side's basic human rights are curbed to ensure the first side's legal protection. And when the industry can discriminate, selling one artist in one country but not in another, that's even worse. Piracy is a way for people to rebel against the industry.

We've let corporations destroy the public domain. Use to be that there was a line between making profit of of another's work and using it. The line is gone, the public domain is shrinking.
This is a mistake. The goal is to promote the arts, Article One section 8, but you don't promote the arts by SHRINKING access. We need change. We need laws that make sense.
Copyright laws are suppose to benefit the public, not hurt us.

I had a video of me playing piano removed (I played 1 minute of a cover song) by order of the rockstar himself! (I now call him a washed up has-been, but anyway..) No profits involved, this was for fun/family/friends. I don't have the gift of writing music, and I've learned to play cover tunes by ear since I started playing...So... I guess unless I write & perform my own material, I can't be viewed on Youtube playing my instrument...?? does this sound right?

there IS a fair copyright use law that allows use of copyrighted material for use in a video, etc. Still, permission is better because there is too much of a gray line on that matter. I choose not to post anything copyrighted stuff because it isn't worth all my time making a video just to have it deleted. I am also creative and resourceful enough to do my own stuff. If you have NO brain for creating original stuff then why be on youtube?

Is uploading copyrighted material wrong or is download copyrighted material wrong? Cause the way interpretted is that if u upload copyrighted material and try to make a profit off of it its is a crime or something. Or if you dowloaded a cd for free and then sold it. But is downloading material copyright infringment when you don't sell it? Because it sounds to me that u commit the crime when u profit from it.

If i want to jump up and down to the music I have the right to do so. is it so wrong to take a video of me doing so? NO. it is not being sold, it is merely being shared. This is a matter of freedom if you ask me. Believe it or not. I think there's an official rule that you can't even show movies, or play movies in an office or other space that exposes it too people. But ofcourse people don't listen.
