Gates is very very smart. A memorandum is an official document. An e-mail has far less legal binding. That is why he refuses to admit that it's a memorandum.

By saying internet explorer was a killer app they were trying to say that microsoft internally acknowledged that IE was intended to remove all competition, using the second definition from the dictionary. unfortunately for the DoJ, a dictionary does not "define" words. a dictionary catalogs the popular use of words. Bill didn't bite, and the rest of history.

Then the lawyer sort of sardonically says "you're familiar with how a dictionary works? " and Gates doesnt even take the bait, but even corrects his definition of a dictionary, then goes on point out the looney nature of his questioning, using pure logic. Gates kicks as.s. imho. i think that bill is not accepting the definitions as stated by the lawyer because if he does, then the lawyer would be able to draw associations between bill gates and the dictionary that gates claims that he has nothing to do with.

It could have been a lot esier for Gates to simply say that directly.
