If you unlock the Eternal mangekyou sharingan and progress with it to a certain degree it can transcend into the rinnegan. The REAL uchiha madara has it, and TOBI has also given one sharingan and one rinnegan to each of the former jinchuuiriki. notice how tobi and uchiha madara are seperate, thats because tobi is not madara at all !
Or it could be that each Mangekyo Sharingan is slightly different, and allows access to different special techniques based on a: the eye's original owner and b: the eye's current owner. Given the 'need a transplant or blind' effect, that would make a lot of sense- since each Sharingan user with a Mangekyo Sharingan uses a different set of techniques, but they all share at least one with at least one other Mangyeko Sharingan user.

@Volkner01 i have read the manga i know tobi is not madara. but again original owner of any set of eyes being dead means nothing. if taken alive or dead they're eyes are still in play and has no affect on who is tobi.

If you read the manga then you'd know that there's a lot of fake (non-canon) stuff in the anime, that never even happened in the original manga, that the anime staff added in.
