Barney is asking for MORE rights for some people. Net effect: Assault people that aren't sexually warped and you effectively get a discount on your sentence.

  • No is stating that ALL murdered gays equals hate crime. You are applying an abstract idea (incorrectly) instead of applying it to real world situations; that is the only way to see if the bill is indeed legitimate.

  • If a black man is murdered because he is black, does he suffer more or does his family suffer more than a person who is murdered out of a traditional motive? Absolutely not. All crime is unfair and should be prosecuted equally. If a gay man is attacked because he is gay, he is no more a victim than a person attacked that is attacked for monetary gain. Get real people.   • As fun as ridiculing or defending Barney may be for some of you, where is the outrage at the bill itself? Unequal protection under the law is wrong. Institutionalized discrimination by the government is wrong. Prosecuting people for "thought crime" is wrong. If a bill to give special protection and rights to only heterosexuals would be wrong, then how is this bill acceptable? The bill would protect child molesters and psychopaths, but not pregnant women or veterans. Barney knows it's despicable.

  • technically, it does protect heterosexuals as well. the bill covers sexual orientation, which could just as easily mean straight or gay.

    we just don't typically have a bunch of gay people violently attacking straight people. the reverse, however is much more prevelent.

    and it's not to prosecute people for thought crime; it's to help prosecute certain actions. case in point, the current hate crimes bill includes race and gender and people are still allowed to be as racist and sexist as they want

    That isn't true. The relative numbers just cover it up.

    Example is a 75/25 percent split w/equally violent people in each group. The experienced victimization of the minority is 9 times that of the majority. The majority isn't one bit more violent or criminal, but the portion of the majority that is concentrates on a small group, while the violent minority's attacks are spread out over a larger group.

    I wasn't citing information. In my example I stated, "w/equally violent people in each group". I was illustrating that even when the majority is not prone to above average violence or criminality, the minority is still victimized at a higher rate due to the math involved. The minority can also be expected to perceive themselves as being persecuted when really it is just the relative numbers that concentrate attacks against them.

  • Its a good sounding argument, but I think that is all it is. I was asking for proof, because in my experience I have NEVER heard of gay on straight violence except for the occasional ass kicking in self defense.

    Even if it were true, it is only argument for the bill because my community is concentrated and there are 300 million straight people to which a margin are hateful and violent towards us.

  • In the 2007 FBI hate crime data, of the known offenders, 3,802 were white and 1,045 black. Per capita this means the black population contains 65% more hate criminals. (The FBI doesn't collect the orientation data needed.)

    There were 1,771 anti-black offenses by whites and 395 against whites by blacks.

    Per capita, blacks were victims of hate "only" 27 times as often as whites (36 would actually be balanced).

    Whites are less likely to commit hate crimes, but the perception is still there.

  • My education is medicine, so admittedly I can't argue this well. but there are problems with accuracy of these numbers too because they don't reflect socio-economical variables. i don't know how you could, but they need to be if this were true to life. Remember these are convicted, and who can afford a good lawyer and who can't. Who was caught. There are more cops in cities than rural areas etc... I truly do appreciate your argument, it just doesn't hold water for me.

  • Part of my argument is based on math.

    An analogy is to put 9 straight and 1 gay hate criminals in a room and let each of them take one swing. The gay criminal will receive 9 punches while a single straight criminal will be hit once (1/9th each on average). The victimization ratio is 81:1. Is it any wonder you never hear of gay on straight violence? The population ratio, not greater criminality, is the driving factor. Hate crime laws won't change that, and they won't tell us this on "Numb3rs".

    If not the thought, then what? The additional criminality is totally contained within the thought of the criminal when it comes to hate crime. The harsher sentencing isn't for the brutality or extent of the crime, it is for having the wrong thoughts while engaging in criminal activity. Criminals often choose to prey on weak victims. How is mugging a strong young gay black man somehow worse than mugging an elderly white woman? It makes no sense and is wrong.

  • The bill protects people based on sexual orientation, gender, and gender identity. This includes those sexually attracted to all manner of things, including children, their relatives, corpses, animals, and inanimate objects... not just other straight or gay people.

    It is thought crime because the additional punishment will be handed down based on beliefs and perception, not just actions during the crime, or actions before the crime in premeditation. Is a random killing spree somehow less wrong?

  • It is about terrorizing a suspect class. We already have a hate crimes law nationally on the books. Where were you for the last few years complaining about the current law?

    The law allows for federal assets to be used, especially, like in the south in the 60s, when local law enforcement refused to investigate.

    One verifiable complaint I have about the bill is that the democrats know it is unconstitutional and so included a clause stating that if any part is struck down, the remainder of the bill will stand.

    "If any provision of this Act, . . . is held to be unconstitutional, the remainder of this Act, the amendments made by this Act, and the application of the provisions of such to any person or circumstance shall not be affected thereby."

  • Would you say that getting back too much change from a cashier and keeping it is on the same par as stealing an election? One results in minor punishment and the other can result in several years in federal prison. Yet neither have to do with thought.

  • Point I was making about the elderly white women victims is why make choosing victims based on their perceived vulnerability carry less of a punishment than choosing victims based on the group they happen to be part of.

    If one person commits a crime because they honestly believe members of a certain group are evil or subhuman, is that person a worse person than someone who commits a crime simply because they recognize an opportunity to do so? Their beliefs are what the longer sentences punish.
