You need to research this subject concerning short sales more clearly. You may ONLY receive a 1099 if the property is NOT you primary residence. If the bank (not the IRS) wants to come after the seller after a sale for the difference after all the negotiations to remove this language then the seller CAN FILE BK and YES IT CAN BE DISCHARGED!
