I was using StumbleUpon a while back and I found a site called SellABand, that has a lot of indy artists; I used music by a Dutch band called Nemeseaon one of my AMVs. Turns out that Nemesea has their own account on YT, and when they saw the AMV, they sent me a message *thanking* me for using their music. I did the same thing for Otep, and she hasn't DMCA'd me either (no comments yet though).

Indeed. There has to be a reason why some are allowed to keep a song, and others not. I do not believe a large company like Google, would flip flop on there rules to this extent. however I agree to be on the safe side stick to royalty free music. No sense risking it. Thou there are times where royalty free music just dosnt fit the video sadly.

I hear what your saying, but... YT is after all Googles' house, and we're invited guests. So regardless of Googles motives, I really can't fault Google for monitoring and choosing to impose consequences on those of their guests who engage in any activity that Google doesn't approve of, going on in their house.
Just as I wouldn't fault you for discouraging any activities, be that swearing or praying, that you didn't approve of, going on in your house, by your invited guests.
Has anyone else noticed that the normal video quality is awful when you upload an HD video. HD looks great, but most people will watch it in normal as there isn't option to watch all videos in HD quality only high quality. When you upload an HD video you don't get a high quality version, so it will default to normal.
It's getting harder and harder to find new non-partner videos. Where are the partners of the future going to come from if the site is biased towards current partners?
Compared to previous videos before widescreen, I'd say that the quality of normal is less.
Sorry I can't agree that partners upload more videos. The vast majority of videos are from non-partners and, certainly in the UK, partners in general don't post as regularly as some of the more significant non-partners (with the exception of the likes of Universal etc). Looking at the top 100 most subscribed (worldwide) 63 have less than 100 videos.
It just seems that the partners can do what they want when it comes to centre pics etc.
Copyright issue is simple, don't use copyrighted material. There are loads of copyrighted videos (eg TV programmes) in the top 100 lists, maybe YT should be more proactive and remove these before getting complaints.
I think the option to flag your own videos as 18+ would be great.
I'm personally sick of "protect the children" crap. Here's an idea. Don't want kids to see nasty shit on the net? Don't let them use it. Easy solution.

Hmmm... no - a video with tons of swearing shouldn't be in the top viewed list. If I were youtube, if someone flagged their own video (or it got flagged by someone else), I wouldn't display it anywhere if the person wasn't logged in or was logged in but had a recorded age of less than 18. Of course, kids could (and would) lie about their age. I don't know how they could enforce that.

I still think we dont have a clear message to google. Some of us are fighting it, some of us support it, and some people are for demotion and not removal.
The first mistake is thinking Google would listen to us. They can't even watch a vid to check the legitimacy of a DMCA claim, how can we expect them to listen to the vids without a legal/ financial context?
For what it's worth... I recently had a video removed from "Live" status, for music copyright infringement. I was given 2 options. Do the Music Swap, or fill out the provided form contesting the infringement. I filled out the form, and I also attached a copy of what I had entered into the form, to the description box for that video.
The next day or two, that video had been restored to "Live" status again, and viewable by all.
The problem with a person has to watch it, the staff member that watches it must make a legal decision for google.. most companies want legal advice for those matters.
One of my videos was pulled and it was my own material. Of course I fought and beat them on it, but this company has pulled a lot of videos that they don't own.
I had uploaded a video that UMG placed advertising on a year ago... and just within the past few months, it's now blocked in some countries, and I don't even know which ones.
About the TOS/TOU, why is it considered a violation if a non-partner like myself tries to upload a video that is 11 minutes or longer? I can understand it being rejected, but calling it a violation?
Oh, I should have clarified that I didn't try to upload a 10+ minute video, but I've read many complaints on the help forums from users saying they have had it happen to them. Under the video uploads, it mentions the video is rejected for being too long, but trying to access the video watch page says it's because of a TOU violation. It's possible that it's not actually a violation, and that YouTube doesn't have a proper error message for that situation.

There are penalties for false DMCA claims but you have to fight it. It is between the video owner and the person filing the copyright complaint.
