The French government is not listening. They didn't ban $cientology out of fear they would just go underground. With Co$ still legitimate in France, they are still highly visible, and open to more charges being filed against them.

Yes, but they can cry to the US government, which always gives France and other countries shit, when they try to do anything against Scientology.
Furthermore they would have more sympathies from the public, being perceived more as the "victims" and martyrs, if they had been completely banned.
Convicting them of organized fraud alone and not more was the right decision, because that's what the trial was about and nothing more.
