Probably YOU are an idiot. An ad does not get banned "because it is misleading", unless someone starts legal action against the brand that is advertised. I cannot see which rival company would feel threatened by this ad.

Moreover, an ad is "misleading" if it is PROBABLE that one might believe what he sees and thus be inclined to act based on that; no one can seriously claim that someone could believe that an M5 can do "800 mph +".

So there you have it - nothing "misleading", just a great ad...

The reason this got banned was nothing to do with the Iron Cross, it was a trade descriptions issue: quite simply, it could be assumed that BMW were implying that here was a comfortable 4-seater supersonic saloon...

I owned an E39 BMW M5 (that was unrestricted) for two and a half years. The Top Speed is 186mph without the electronic restriction. This is faster than the Lotus Carlton's 174mph claimed. I now have an e46 M3 but in truth I preferred my M5 all around, so may change again to a new shape M5 next year, again I'll want the restrictions lifting.
